Why me? Got hit by a car.....
Not me personally, the car I mean...
Pics here http://www.HordePC.com/CarWreck/ I'm ok, didn't die or anything, scared the hell outta me though. I was headed westbound, turning south into a driveway, BAM clobbers me from the driver side. to the lady in the other car..... Trying to pass a car with the left turn signal on the left isnt a very smart thing to do. Basically she tried to make it sound like it was all my fault for going too slow, but the officer cited her for unsafe passing, so I win. Besides, who turns into a gravel driveway at 45mph (her speed) anyway? Insurance is still investigating... She will probably be found at fault. Some circumstances were that the sun was in our eyes as we were driving into the sunset, but really, thats even more of a reason to not try and haul ass around me at 45 mph. Basically, the wheel chassis thingie is completely seperate from the car now, tow truck guy jacked up my car to get a good look at it.. the wheel stayed on the ground the whole time. Pretty funny. Oh well, her insurance will probably wind up paying for the whole thing. My insurance company was rad. The tow truck guy was retarded. took him 2 hours to get it on the truck. Anyways, I'm a bit wore out, a bit upset, and clueless as to what to do. This is my 1st wreck. I had it towed to a local dealership last night, called today to find out that they dont do body work, so they are gonna have it towed to a body shop (no doubt they will bill it to me) which sucks since I just payed for towing (78$) last night. so any advice? |

Make sure you get a copy of the police report in your hands,
Follow up with the insurance company. Any kind of achiness you are feeling the next day, I'd go to the doctor. Good luck...

Aww, man, that happened to me...except it was kinda my fault cause my left turn signal/brake light was out and she thought I was turning right. But I didn't know it at the time, and she didn't want to involve insurance, so her husband came out to replace the fender (the only damage).

Keep receipts for every penny you spend on this that comes out of your pocket, you should be reimbursed for towing expenses etc. Demand that the body shop uses only genuine Honda parts, do not accept after market parts. You can have anybody you want repair the vehicle, you don't have to use who the insurance company wants you to use. The insurance company should be renting you a car do not let them tell you that you are only entitled to it for so many days, you are entitled to it until your car is repaired to your satisfaction. They are required to restore your car to the condition it was in before the wreck....DO NOT accept anything less than that.

Go to the doctor RIGHT NOW and start your medical history. You might have injuries that won't show up for a day or two - - -happened to me and now, 13 years later, I still have back pain from the wreck. You may need to file for medical damages - you don't want to mess around with the early stages of this or you might have to fight very hard in court to get compensated for it.

eh, I'm fine. Seriously, I'm not damaged, I've just had the shits cuz im so stressed out over being out of work now.
I dunno, anyways, I've kept my reciepts, and I haven't talked to anyone about a rental car.. I just have the bare minimum liability only insurance. So I don't think I get a car do I? feh. I dunno. |

Oh man, I just got into a wreck that sounds like yours. Except my car just got barely scraped. I was the one making the turn, so I was found at fault. However, I'm certain that she was speeding to make it through a yellow light, and ended up not being able to be a defensive drive because of that.
Anyway, glad you're not hurt. Accidents are a bitch. |

wow, look how old this thread is. Now take into account the following information
1. My car is still not fixed. 2. Long story Basically, I started by calling my insurance company (progressive) and the guy pretty much wound up doing NOTHING for me. As in he said he'd get the police report, call thier insurance company, the other person who hit me, and see what would go from there. After a week and a half go by, I get a little antsy, I call him up and see what the hell is going on. He never called anyone, and said he couldn't get a phone number, which was funny since when I called progressives main customer service number, they gave me the phone number of the insurance company which he claims wasn't on the report. Well, catching him either a lie, or incompetence, either way, I was pissed off at this point that he wasted my time and didn't even try to call me or give me a status update. I give him the phone number and he assures everything will be taken care of soon. Another week goes by, nothing. I finally get pissed and fed up and call up the CS center and get the contact info for my agents supervisor. Left a message with him, by the next day, this guy is all over my phone calling me trying to give me status updates. Nice. Well I get curious and call the other insurance company. Its some No-Name place I've never heard of called "Workmans Auto Insurance" 1st thing I notice is while on hold, I get thier hours, and then hear that they are based on EASTERN time. Ugh. I'm dealing with an insurance company that I've never heard of on the other side of the damned continent? this is pathetic. I get on the phone with someone there and tell them what is going on, give them the police report number and my claim number with progressive and all that jazz. So in doing all this I find out that the person who hit me never opened a claim. Irresponsible inconsiderate bitch? or no? Well fine, I get the ball rolling, and because of the time zone diff, we wind up playing phone tag for another week, The guy that is assigned to my claim at thier office has the kind of phone system you learn to hate. Dial the number, dial the extension. If he's not on the phone, it will ring, he will possibly answer if he is in. If he's on the phone, it will sound like its ringing, but actually just dump you to his voice mail. Guy doesn't ever return messages. So, here I am, over a MONTH later Without my car. Progress so far? Fuck if I know. Last I heard, they requested a damage claim from the place that has my car, but have not contacted me as to if they actually got off thier keester and made a liability decision or not. They pretty much told me flat out that they don't owe me anything until they make that decision, so... what the hell? Tommorow is the guys deadline to get ahold of me, otherwise I've been advised by family members and friends alike to seek legal aide. Anyone who's an insider on this shiesty as fuck industry that can give me any advice? Basically, the things I want are. Compensation for being out of work for a month (my dad paid my rent this month, my girlfriend is working 2 jobs now and will have to probably make the next payment for me.) none of my bills are getting paid, my cell will be shut off pretty soon. I'd like all that taken care of. My car. anything else I'm missing? |

Those are common insurance practices. You've done a good job so far, but keep on it. I'd tighten my callback times. They'll screw with you until you're desperate and try to lowball you on a settlement amount.
What state are you in? Since so much time has elapsed your Insurance Commissioner's office may be able to help. Look them up online. (google 'state "insurance commissioner"') They should have a consumer protection hotline you can call. Be prepared to file a complaint. I wouln't drop the bomb before you've called for details, but depending on the case even the mention of a commissioner complaint can motivate adjusters that use poor communication as a tool.

OK so, I just tried to call them yet again, Still no answer, dumped to voice mail. :\ lame.
Anyways, for more info, I'm in Idaho, and that is where the collision took place, however, her insurance company is in Florida. Cyrnel No idea if im supposed to be lookin up idaho or florida here buddy, but maybe someone can point in the the right direction. |
