Let's get something straight right off the bat: if it is your computer it is not illegal.
If you own the computer, then you are free to monitor it's usage. If it is your girlfriend's computer, then you are breaking several laws, both state and federal. As far as your suspicions, you need to rock up and ask her flat out. Stop being a pussy and trying to figure it out. If she's cheating on you, she'll lie about it if she chooses. It's up to you to believe her or move on your accusations and suspicions. And if I were her and I was being accused of something I wasn't doing and still taking the heat for it, I may as well do it.

Yeah, it's perfectly legal to monitor your computer. I can't say I recommend it for those who are paranoid like the OP, but it certainly isn't illegal.
There are numerous court cases detailing people who have done the same thing: recording phone calls, keyloggers on their company computers, etc. In many cases, if it is your personal computer or your phone*, another person doesn't have a reasonable expectation of privacy. You don't need to check her email. You confront her and call her out on your suspicions. If she lies, she lies. If you still feel bad, get rid of her. Just make sure you do it with a very stern and masterful gaze. ... * Trivia: There are many specific state and federal 4th Amendment (search and seizure) laws pertaining to the recording of telephone calls. In most states, all it takes is one party to grant permission of the recording, but in other states, such as Maryland, you cannot record a phone call unless both parties are aware. Emails, however, are not treated with the same level of protection as of yet. Laws always lag behind tech. In some cases, old, opened emails are considered legit targets over unopened emails. I'm sure most companies have email policies that employees have access to, and I'm also sure they notify employees that they may be monitored.
Either way, that's in a business environment. Some companies have been sued for breech of privacy, and so having policies in place have become important. The rules are a bit confusing. I'm not sure I'd take any chances on a personal level.

I prefer stare deep into my girlfriend's eastie-westie areolae.
... One of the more fun things that keyloggers can do is be attached to wired keyboards such as on desktop computers in the form of a device similar to a thumb drive. I think 9 out of 10 threads that have "keylogger" some where in the title is going to be suspicious. I bet that other email-hack thread was about his girlfriend too. Like everyone else has said, you need to confront her about it and get over your insecurities. Which you probably won't do, so.
