Yeah, it's perfectly legal to monitor your computer. I can't say I recommend it for those who are paranoid like the OP, but it certainly isn't illegal.
There are numerous court cases detailing people who have done the same thing: recording phone calls, keyloggers on their company computers, etc.
In many cases, if it is your personal computer or your phone*, another person doesn't have a reasonable expectation of privacy.
You don't need to check her email. You confront her and call her out on your suspicions. If she lies, she lies. If you still feel bad, get rid of her.
Just make sure you do it with a very stern and masterful gaze.

In most states, all it takes is one party to grant permission of the recording, but in other states, such as Maryland, you cannot record a phone call unless both parties are aware.
