car damage

*edit* i found out that my home insurance should cover it.

I guess this would be the place to ask this.

tonight i was playin disk golf. The place i was playin at has the first few pins by a road, and it was raither windy out. Basicaly, i throw, and the wind catches the disk and it hits a car that is going by. Now, the guy was cool about it, but i am wondering what my rights are as to what i have to pay, and i will pay for it and all. I gave him my name and number so he can get in touch with me.

Also, he workes for papa johns pizza, and was on a delivery. I dont know if this has anything meaning or not, just thought i'd say that.

The dent in the roof is very small, and i know could be taken out by a ding-king type device.

any help here would be very helpful.

Not sure but since no one else replied, I figure I'd take a stab at an answer. I'd say since you were out in a public place and since the course does have its pins close to the road, if you get sued you could probably get a lawyer to figure out a way where it's not your fault. But since it was "technically" a company vehicle, the guy might just get papa john's to pay for it. It would seem like a lot of work on his part to get a $100 dent replaced.

Well. Liability law is a complex beast.

So common sense tells us it's your fault. You should pay.
Lawyers would figure out a way to sue somebody else. Wind generators, course owners. Somebody. Remember, in jury trial you don't have to outrun the bear, you only have to outrun the other guy running away.

I agree with tehhappyboy. Whatever the law might say, the only decent thing to do is to pay for it.

pizza delivery guys almost NEVER have commercial insurance on their vehicle. I have worked as a driver and cook in several places in the past.

This guy will absolutely not go the insurance route... offer to pay for dent removal, but don't worry about anything else. For him to pursue you in any legal avenue, his insurance would be cancelled for driving a delivery vehicle without commercial insurance.
