It has all been said but this case deserves endless comments.

First of all, I don't even answer the phone after 9 and I would be pissed if someone rang my doorbell that late. I just have to get up too early. I would not open the door either. But I would sleep just fine and if I had an upset stomach the next morning I certainly would not associate it with the previous nights events.

This woman is a real piece of work. She makes me question the future of humanity. The fact that this is the dumbest lawsuit I have ever heard of should have been enough to get it kicked out of court. The fact she did not go to the ER until the next day should make it clear she was full of it. Clearly she was just being greedy when she refused to let the girls cover her unnecessary expenses.

But the best part is that her husband has been harrasing the girls and their families. I can not believe that they could not turn that into a lawsuit to recoup their losses in the first case.

I hope the woman and her husband are run off the planet.

There are people like this crab in every neighborhood. Happy ending? Karmic justice? Maybe.
The girls didn't have to pay due to others' generosity...their good deed comes home. I'm glad to see that people rallied to help out the young girls.
Battleaxe's life is in upheaval, she's unhappy...her crap came right home too. If she hasn't learned anything, then she'll spread that attitude somewhere else.

"The victory wasn't sweet," Young said. "I'm not gloating about it. I just hope the girls learned a lesson."

Meanwhile, Richard Ostergaard, father of Taylor, got a restraining order against Young's husband, Herb, in county court, claiming he continues to make harassing telephone calls to the Ostergaard residence.

Wanita Young said, "This has turned into quite a fiasco. It's something that never should have happened and it's just devastating. My phone hasn't stopped ringing. My life has been threatened and I'll probably have to move out of town."
THEY FUCKIGN OFFERED TO PAY HER MEDICAL EXPENSES, AND SHE TOOK THEM TO COURT ANYWAY!! What the FUCK is wrong with some people??? And 49 is NOT fucking elderly. My MOM is nearing 49, and I'm 24 next month.

AND WHAT LESSON???!?!?!? There's not enough cursing I can do in this thread to express my frustration and anger at the stupidity of this woman.

Also, I'm very glad that someone (the radio station) stepped in to uphold common sense and help out these two girls. Hell, I'd donate money just to teach that stupid bitch a lesson in being a decent fucking human being.

Yes, but would it work? Would the woman learn a lesson? Sadly, no, she would just victimize herself all over again.

Regardless of how unfortunate the circumstances get for the girls it is only through their actions that this entire situation exists. I'm not doubting the fact that this woman and her husband are sour apples who took things a bit too far but none of us where there and we haven't a clue as to what actually went on. There's no point in speculating about this woman's character and the validity of her claims when there's the conclusion of a court of law for us to go on.

It's an unfortunate situation but it's not the place of our court system to completely disregard the rights of people because of the intentions of others.

if I posted what i felt about this it would probably just get deleted... so I wont... but the judge who gave this award has brought great humiliation on his office and his court, it is just utterly amazing that such a decision could be made.

I am glad at least that the radio station stepped in to pay the girls fines.

Sometimes I can't believe the behavior of people.... First of all, 49 isn't very elderly, and she had a husband. Being in Colorado... well, I'm not even going to go into that...

But, still. These girls offered to pay near $900 in medical costs for the woman who was apparently so scared that she had to go to the ER (GASP! someone's left cookies on my doorstep with paper hearts and the signatures of a couple neighborhood girls that I know!!! SOMEONE HAS IT IN FOR ME!!! THE APOCOLYPSE IS NIGH!!!)... and yet she took them to court ANYWAY! This just screams at me "lawsuit for personal gain, spite the suffering and goodwill of the people!"... really, it's sad what people will try to do in order to get a few extra bucks these days. It really teaches everyone the lesson that no matter what you do, no matter what your intentions, someone will always be standing by to see how they can profit from your tiniest flaws.

... I think this woman deserves whatever she gets, and hopefully she'll move her filthy deeds somewhere that I don't have to worry about getting sued for honking at her while she jaywalks in front of me... (hearing loss! emotional damages!!)

Their actions say they were willing to pay the woman's medical bills regardless of how responsible they may have felt for the bills. To me the situation should have been left there and never gone to court.

The court should not have allowed this woman to railroad the girls and charge them for court costs when she just as well could have gotten the medical bills paid WITHOUT the court costs. Because of the woman's lack of cooperation with the girls I don't believe that she should have been awarded the money. It reflects an unforgiving, spiteful, and possibly greedy attitude. Why else would she have taken the girls to court when they were willing to make things right in the first place?

And INTENTIONS play a large part in our courts. The question of whether harm was INTENDED to a person can mean more to a judgement than what specific harm was done.

I never said the punnishment fit the crime. I said the girls and their parents were showing a SEVERE LACK of responsibility on their behalf. Granted she isnt "elderly" but she is older, and has a family. Many people I know that have families or a career are at home and in bed by 9 or 10, these people are also 30 and up so I dont find it so weird. Hell by 9pm my parents are at least in their bedroom if not already asleep, by 10:30 my Dad would have met you with a shotgun. Those girls would have had 2 lead sammiches and a side of steel. I dont agree that they were forced to pay her medical bill and court costs, but they should have known better.

http://www.dailybreeze.com/news/nati...s/1229527.html

The girls wrote letters of apology to Young, with Taylor saying in part, "I just wanted you to know that someone cared about you and your family."

The families had offered to pay Young's medical bills if she would agree to indemnify the families against future claims. Young wouldn't sign the agreement. She said the families' apologies rang false and weren't delivered in person, so she brought the matter to court.

you know what, fuck this lady.. hardcore. Shes just after money, and I dont care that she'll have to move.. GOOD one less pest in the neighborhood. The families offered to handle this like civil human beings without dragging it to court. I thought that the lady had just been a little crazy and taken it straight to court. The girls probably didnt come in person to deliver an apology because they were fearful. Writing a letter takes time and thought. A letter is much more heartfelt than an e mail or phone call. At first I thought the girls were out a bit late and had made a terrible judgement on when to be out. Now I cant say that I agree. The families agreed to pay her medical bills, yet she still took it to court to seek "punitive damages". From either article I cant see what punitive damages would need to be recouped.. but from the daily breeze article I cand DEFINATELY see shes just in it for the money. I wouldnt be shocked if she sought moving costs from the girls because of threats against her life.

This lady is dumb. I want to cart her off to an island with all the other dumb people.

I just noticed this phrase " She thought they were burglars or some neighbors she had tangled with in the past, she said."

Neighbors she'd tangled with? Was she living in a bad neighborhood or just didn't have a good relationship with her neighbors? Was she pissy with her other neighbors? Makes one wonder why she thought this.

Oh and "A kitchen light was on at Young's home." so there's no reason for them to have suspected that everyone was in bed.

Ok, that ruling was absolute bullshit. It's clear the lady has extreme paranoia and shouldn't be part of society. If that lady had half a brain stem she should have called the police. But no. This lady is one of those that I would purposely through a restraining order wrapped around a brick through her window. And if anyone likes this post, you'll love this story (Anyone remembers it or can find the article since I am bound by dial up internet, post the link).

A man began choking in a restaurant (I believe it was an allergic reaction to food that closed his wind pipe) and a medical doctor saved his life by performing a tracheotomy with a steak knife and straw. This man had the gall to sue this doctor for a scar that was left on his neck. I say to hell with that scar. If I were that doctor, I would threaten to use that knife again.

Yeah, and it sucked when I was in high school. I played tennis and when we made semi-state, if your parents couldn't attend the match, you couldn't play because in Indiana, it isn't enough to chaperoned by a teacher or coach. I was captain of my team and almost missed semi-state because my parents both have jobs and other children... imagine that.

I have to agree with Analog...WTF!

This should not have made it as far as it did. The judge should have said, "Fine - pay the med bills and get this piece of shit case off my docket"! Honestly, I'd be willing to bet that there is some bad blood between those involved, and that we don't know the full story on either side.

You weren't there when the girls dropped off the cookies. You weren't there to see the woman's reaction. You weren't there when the court was hearing the case.

You should feel free to have your opinions on this matter just as I do - as long as you aknowledge that they're irrelevant.

Quote:

I'm not one for speculation but since the seems to be the name of the game, I'll play. Let's assume that these girls weren't the little sweet hearts they claimed to be. Judging by their actions (the delivering of cookies at a "late" hour and the "terrorizing" of an "elderly" woman) shouldn't we assume that these are the same sort of people who wouldn't pay the woman's medical bills? Who's to say the woman went to far? In regards to their character, what do we have to go on?

This is why I suggested we just go along with the decisions of the court.

Quote:

I agree, it's certainly a nasty way to go about things but, realistically, the woman didn't do anything more than capitalize on an option the girls left open to her. Two wrongs don't make a right but this situation wouldn't exist were it not for the actions of those girls (and the evident negligence of their parents).

Quote:
And INTENTIONS play a large part in our courts. The question of whether harm was INTENDED to a person can mean more to a judgement than what specific harm was done.
What about the possibility that the woman was effected exactly in the manner that she claims to have been? It's pretty obvious that the woman has worked pretty hard to facilitate all of this but what if it all went as she said it did? Should she be forced to pay her own medical bills for a situation she did nothing to create?

These circumstances demonstrate the difference between what "feels right" and what is true. Justice doesn't always conincide with our feelings and it's not the job of our court system to decide a ruiling on how a case feels. In the face of the relentless veracity of justice, our opinions and what "feels right" are irrelevant.

Feb. 12, 2005 — The Colorado woman who sued two girls after they made an anonymous, nighttime cookie delivery said she and her family have been the target of hate mail, harassing phone calls and even death threats.

Knock at the Door

It all started last summer when Taylor Ostergaard, now 18, and Lindsey Zellitti, now 19, decided to stay home from a dance in order to surprise their neighbors with an anonymous delivery of homemade cookies.

But Young, 49 — appearing on "Good Morning America" with her husband, Herb — said she became so terrified when the girls banged on her door at 10:30 p.m. and ran away that she suffered an anxiety attack that sent her to the hospital the next day. Young sued the girls and was awarded about $900 to recoup her medical bills.

The girls, who appeared on "Good Morning America" last week, said they were just trying to do a good deed. They have received an outpouring of public support and donations to cover their legal bills. A company has even named a "kindness cookie" in their honor.

But Young contends that the teens used "very poor judgment" in not realizing how their behavior could affect others.

Young said her home is in an extremely rural area, and Ostergaard and Zellitti had to climb over two fences, walk through a pasture filled with livestock and crawl across an open ditch to get to her home.

Once there, Young said the girls went to a secluded back door and knocked. She, her elderly mother and teenage daughter were in the basement at the time.

"They banged on the door so hard, we were certain someone was trying to break in," said Young.

Different Accounts

Also at issue in the case is what happened after the cookie delivery.

While the girls and their families said they promptly apologized to Young and offered to pay her medical bills, Young said that is not the case.

She said that the controversy could have been avoided had the girls simply acknowledged their mistake immediately.

"Do you really believe if these people gave me the $890, I would go through the process of going to court to ask for $890?" said Young. "There was never any money presented. I tried four different times to communicate with the Ostergaards, and all four times they had no desire to settle the matter, right up to the time we presented this to court."

'Has to Be Some Accountability'

According to the Associated Press, the parents of one of the teens has filed for a restraining order against Young's husband, Herb, accusing him of making harassing phone calls. He admitted calling the Ostergaards once after hearing the teens were talking to the media and at one point said "the gloves were off," said the Associated Press report.

But Herb Young said on "Good Morning America" that the public has misunderstood what his family has gone through.

"People take it upon themselves to judge, and they don't know really the full extent of what happened," he said.

Despite the bitterness surrounding the incident, Renea Young said she would do the same thing again.

"There has to be some accountability, some responsibility taken," she said.
obviously, troit is right... there is more too this than everyone is assuming. when i read the original story, i pictured a normal suburban neighborhood with houses not even 30 feet apart, but that doesn't appear to be true. does this fact make the lady right? who knows... she obviously feels she did the right thing. while many of us wouldn't have taken the situation to such extremes or gotten so worked up over it, that doesn't mean this lady is completely wrong for what she did.

i still support the two girls because their actions were quite innocent, but i feel bad for judging the woman so harshly after filling in many of the story's holes myself and making large assumptions that were incorrect.

i think the most interesting part of this situation is how the media can take a point of view and lead their audience to make certain conclusions or take certain sides... the original story was certainly biased in favor of the two girls, and not coincidentally, so are nearly all of the replies in this thread.

Looks like the suing couple have had some problems.
Quote:
Couple take lumps since cookie suit
Durango - Herb Young turned the telephone off again Tuesday after it rang at 12:40 a.m.

One recent caller had told him that "you should be found dead in a ditch."

Nine out of 10 calls to his house are from "crackpots," he said, ever since a plate of cookies and a case in La Plata County Small Claims Court turned life upside down.

Since his wife, 49-year-old Wanita "Renea" Young, successfully sued two 18-year-old girls for scaring her with a late-night knock on the back door and a then-anonymous cookie drop on the porch, she and Herb have spent the last two weeks trying to defend themselves. A barrage of crank calls and hate mail and truckloads of strange packages have been aimed at their rural home just south of Durango.

Almost everyone but the magistrate has taken the girls' side in the court conflict over about $900, part of the medical bill for Renea Young's anxiety attack. The case made headlines around the world.

"Last week the calls were all day, every day, and all night," Herb Young said. "It's slowing down."

He estimated that one-third of the calls to his home have been from the area, but two-thirds are from all over the country.

Many strangers have made their own cookie deliveries to the Youngs, everything from elaborately wrapped and expensively stocked gift baskets to an envelope holding Oreo crumbs.

Nationally syndicated radio talk-show host Michael Gallagher sent 1,000 boxes of Girl Scout cookies to U.S. troops abroad in honor of the "Colorado Cookie Caper" and the two girls who were sued, Taylor Ostergaard and Lindsey Zilletti.

On Tuesday, the Youngs' rural mail carrier told Herb Young that she had two small truckfuls of packages for him, but they appeared to be empty boxes.

"Send them back," he said he told her. He wasn't sure how to interpret empty boxes.

"Some people have been almost pleasant and said they were just calling 'to voice my opinion,"' he said. "The flip side is that I've heard every profanity you can imagine. And people threatening to cut me up or beat me up or my wife."

One caller told the Youngs that "you are what's wrong with society."

"All this over cookies," Renea Young said.

She is so devastated, she said, that she hasn't been back to her part-time job as a Wal-Mart cashier.

More evidence of how this world is going crazy.

What we need is more people like these young girls who have community spirit , and less of the 'someone else should pay for this' culture.

Very very sad.

I have a word for that.

Ridonkulous.

See, they're cookies. They said "Have a great night". Not "I'm a creepy stalker dude who is making cyanide suicide cookies and wants you to join this crazy cult where we worship the inventor of bubble wrap. Eat them and be safe for eternity." NO! They didn't say that! "Have a great night."

If you manage to have a heart attack over that, you have bigger problems. Problems that $900 from a couple of goodwilled teenagers will not fix.

Once again, a slap from the common sense glove. Every judge should keep one on his desk, right beside the gavel.

How has this lady made it this far in life when all it takes is the ringing of a doorbell at 10:30 to send her to the ER? Simply amazing. With anxiety levels that high it shouldnt take long before she worries herself to death.. literally. hopefully she doesnt have any offspring.

If I were in the same situation id go back to the lady's house at 11:30.. ring the doorbell.. and set of some loud fireworks.. run. The problem would take care of itself.

"Our home is like a funeral parlor," Renea Young said. "They've robbed us of our laughter. My spirit, my soul, is damaged."

Here's the kicker. Wait for it...wait for it...

"I don't know how to change. I don't know how to compromise my principles," she said.

Old signature just wasn't doing it for me anymore, so now I have this new one. It's equally as stupid but at least it looks really long. I'm probably just going to keep typing until I run out of things to babble about and see how many people actually read this. I once ran down a hill, fell down and hurt my elbow; my mom said I would be ok, she kissed it and made it all better. I've run out of things to say now, so if you have read this whole thing, congratulations you get a gold star!

follower of the child's crusade?

in my opinion this women should be pelted with rotten fruit every time she steps into public for the next ten years.

is that too harsh?

And to say that she was only seeking payment of her medical bills is a lie. It is possible the girls didnt offer to pay the medical bills (as was widely publicized) but the simple and straightforward fact is that the suit sought puniative damges.

Because someone knocked on her door and left her some cookies. And as for all this climbing through ditches and over fences bullshit, are we seriously expected that these people crawl through a ditch every time they go to and from their house?

The woman also has a history of bringing stupid lawsuits... she is just a crook, trying to exploit a simple act of kindness. Luckily the girls did not suffer, because their fines were instantly paid by donations of normal citizens.

The women and the husband who brought the suit are scum. its that simple.
