yes they can.. but that same technicality can also cause her mother to be responsible for the 12 year old's actions.

Seriously, they're pricks, but RIAA are within their rights to go after this girl. She downloaded pirated music, she committed a crime, she takes the consequences. If she wasn't old enough to realise what she was doing, then her mother should have explained it to her, and suggested that she find something else fun to do.

This is exactly what the RIAA doesn't need right now, this bad publicity. Media will be all over it.
Way to go Cary. Perhaps you guys *wanted* to look like the bad guy?

Honestly, they didn't know who it was when they targetted an IP. It's not like they can go "Yea, this one's a 50 year old widow. Add her. Oh, skip that one, it's a 12 year old on her mom's computer."
And I really doubt that the "service fee" that's paid is to download music. I think she means her ISP fee. Yes, this is bad publicity for the RIAA, but they're well within their rights to target this girl.

When I was 12 I dont think I would have known. Why would it be illegal to download something Thats free on the radio and MTV? What is a copyright? Parents have no idea what computers can do let alone be able to monitor what there kids are doing. This is a sad case. If I was the RIAA I would have considered leaving this one out. It willl only generatr more bad publicity towards themselves.

You can thats what services like iTunes and such are offering.
I forget the name of the major one for PCs though. iTunes I believe charges .99/song and the other charges .79/song.

you know, my whole outlook on the downloading music thing is that it is no different than copying tapes for your friends back in the 80's. Sure you can get more music than tapes could ever give you but I don't see this hurting anyone. The music industry has been shafting all of us for years and for them to sue a 12 year old girl, is absolutely petty and ridiculous.
In case you don't know, music companies make their money off of CD's, DVD's, etc; whereas the bands make their money on the road and selling merch that way. Metallica was foolish to get in the middle of things when all the internet trading was doing was making them more accessible than ever. To hell with RIAA and Metallica. |

I'm going to go burn 10 copies of evey CD I own, then I'm going to give those fuckers away.
I am just not going to buy any CDs until RIAA cuts this shit out. Their business model is dead, they just don't want to admit it. Seeing as there is very little good music put out by major labels, I don't think I'll miss much.

This is just like stealing satellite TV. It's going to evolve into a cat-and-mouse thing where people find sneakier ways to download music, then the industry finds ways to combat it, repeat ad infinitum.

I'm with the rest of you, and especially with johnnymysto: its only going to get people to go further underground and win anyway. heh heh heh............. go pirates!
