12-Year-Old Sued for Music Downloading

Tuesday , September 09, 2003

NEW YORK — The music industry has turned its big legal guns on Internet music-swappers — including a 12-year-old New York City girl who thought downloading songs was fun.

Brianna LaHara said she was frightened to learn she was among the hundreds of people sued yesterday by giant music companies in federal courts around the country.

"I got really scared. My stomach is all turning," Brianna said last night at the city Housing Authority apartment where she lives with her mom and her 9-year-old brother.

"I thought it was OK to download music because my mom paid a service fee for it. Out of all people, why did they pick me?"
Unfuckingbelieveble! She even paid to download music!

legolas 09-09-2003 08:23 AM

Can't they use some kind of technicality because she's 12?

Cynthetiq 09-09-2003 08:28 AM

yes they can.. but that same technicality can also cause her mother to be responsible for the 12 year old's actions.

cuz they're evil bloodthirsty bastards!

TIO 09-09-2003 09:00 AM

Seriously, they're pricks, but RIAA are within their rights to go after this girl. She downloaded pirated music, she committed a crime, she takes the consequences. If she wasn't old enough to realise what she was doing, then her mother should have explained it to her, and suggested that she find something else fun to do.

johnnymysto 09-09-2003 09:08 AM

RIAA is the devil!!! Bloodsuckers!!! Down with the Man! What does this 12-year-old girl have to give back to the artists whose music she downloaded? She ain't got no money! This is total BS!!!

But she paid 29.99 a month to download the music..

Blue 09-09-2003 09:16 AM

that sucks, i feel sorry for the little girl.

the RIAA is gonna ruin either her life, or her mothers, because they didn't make a buck.

tinfoil 09-09-2003 09:31 AM

Leave it to those greedy little ... *grumble*

punx1325 09-09-2003 09:35 AM

Oh they will claim amnesty and everything will be ok. And if worse comes to worse, the judge will drop the case cause shes 12!!!!

tinfoil 09-09-2003 09:42 AM

This is exactly what the RIAA doesn't need right now, this bad publicity. Media will be all over it.

Way to go Cary. Perhaps you guys *wanted* to look like the bad guy?

Esoteric 09-09-2003 09:50 AM

RIAA is fucking stupid. Sorry to hear that about the girl.

CapnWaffle 09-09-2003 10:07 AM

That's pretty fucking retarded. I seriously doubt that a 12 year old girl should be on the top of thier lists.

Like others have said though, the media eill probably fry the RIAA over this.

Pragma 09-09-2003 11:57 AM

Honestly, they didn't know who it was when they targetted an IP. It's not like they can go "Yea, this one's a 50 year old widow. Add her. Oh, skip that one, it's a 12 year old on her mom's computer."

And I really doubt that the "service fee" that's paid is to download music. I think she means her ISP fee.

Yes, this is bad publicity for the RIAA, but they're well within their rights to target this girl.

bender 09-09-2003 12:01 PM

Pragma, your bang on with your remarks.

StormBerlin 09-09-2003 01:00 PM

Good point Pragma

Akira 09-09-2003 01:15 PM

Looks like some bad publicity but all shall be forgoten when they sue her mother instead.

dr_clocker 09-09-2003 01:54 PM

When I was 12 I dont think I would have known. Why would it be illegal to download something Thats free on the radio and MTV? What is a copyright? Parents have no idea what computers can do let alone be able to monitor what there kids are doing. This is a sad case. If I was the RIAA I would have considered leaving this one out. It willl only generatr more bad publicity towards themselves.

mingusfingers 09-09-2003 02:07 PM

Haha...sweet. I think a boy in ontario got the same treatment. But she was even paying a fee. That's hilarious.

What! I thought we canucks were safe

a2k 09-09-2003 04:17 PM

I think the fee that she paid was for kazaagold or something like that. Regardless, isn't the RIAA saying that right now they're going after people who are sharing music, not just downloading it?

It's true that they were just targeting to IP but what this is is a very clear example of why these subpoena's are so stupid in the first place. They have no idea who they are targeting, the IP they sue might not even be a person, could be a program. You can't just sue everyone and any company that has enough power to start sueing everyone is way way out of control. The RIAA sounds like a joke to me, everyday they come closer and closer to 1984 big brother. Sure the people stole music, added and abeded that crime if you hear an mp3 playing loudly in someones car, now YOUR a criminal, where does it stop?

What happens when the target IP is one of their own? Most of the movie bootlegs (cyberspace and meatspace both) are originally from people in the movie business, so shouldn't it make sense that at least one of the main pirates would be someone in the music business, especially for 'sharing' the music of their competitiors?

Then again, maybe they just conveniently ignore those.

I don't think so Tim, us Canucks are immune to the RIAA. We don't have the DMCA up here either.

Rather, we have CRIA... bastards won't even return my email.

Himbo 09-09-2003 05:00 PM

Yah . . what's up with suing someone in Ontario Canada? I thought RIAA stands for Recording Industry Association of America . .what the hell r they doing suing people in other countries for !!

MacGnG 09-09-2003 05:55 PM

Oh man thats funny. Thanks MacGcG. Either way, leave her alone, leave us alone. I really dont think were hurting anyone. And i say 'We' cause i know 99% of us have something illegal on our computers.

bundy 09-09-2003 06:32 PM

young lady, you are found guilty of downloading too many *NSYNC and Aaron Carter songs.

you will now pay with your soul.

for gods sake, give her a break.

The RIAA, perhaps wanting to make bad publicity go away, has settled with Brianna LaHara. As reported earlier, Brianna was one of the first named in the RIAA's 261 lawsuits all over the USA.

Brianna and her mother will be out of pocket for $2,000, a small sum considering she could have been on the hook for hundreds of millions. Who said the RIAA doesn't have a heart?

Brianna had been under considerable emotional stress, what with being sued by an association with billions of dollars at it's beck and call.

Did the RIAA extend to Brianna their amnesty program? One only wonders.

This case is only the first of many misplaced lawsuits. It is a testament to the fact that the RIAA is NOT putting any time or effort into the lawsuits. They are not finding out who is on the other side of the IP address.

Am i the only one who sees this as a good thing for the RIAA?

They want cases like this to publicise their problem, and cause fear in people, reducing dl'ers..

If they continue, its just publicity for their 'problem'.

I received an Instant Message on Kazaa from the CRIA. Stating that they notice I am sharing files and a warning to me, and a link to see their website about it.

The_Dude 09-09-2003 08:44 PM

just heard that the mom settled the case for $2000.

krd913 09-09-2003 08:48 PM

Maybe if you could buy the songs you like and not have to pay $20 for a cd to get 2 good songs and 10 junk ones

krazykemist 09-09-2003 10:01 PM

You can thats what services like iTunes and such are offering.
I forget the name of the major one for PCs though.
iTunes I believe charges .99/song and the other charges .79/song.

Ganguro 09-09-2003 10:33 PM

tough nuts kid..
you break the law, you get sued..
and mom, you are a fuckwit for not supervising your kid's online activites.. I hope the lawbreakers fry :)

dylanmarsh 09-09-2003 10:38 PM

you know, my whole outlook on the downloading music thing is that it is no different than copying tapes for your friends back in the 80's. Sure you can get more music than tapes could ever give you but I don't see this hurting anyone. The music industry has been shafting all of us for years and for them to sue a 12 year old girl, is absolutely petty and ridiculous.

In case you don't know, music companies make their money off of CD's, DVD's, etc; whereas the bands make their money on the road and selling merch that way. Metallica was foolish to get in the middle of things when all the internet trading was doing was making them more accessible than ever.

To hell with RIAA and Metallica.

billege 09-10-2003 12:12 AM

I'm going to go burn 10 copies of evey CD I own, then I'm going to give those fuckers away.

I am just not going to buy any CDs until RIAA cuts this shit out. Their business model is dead, they just don't want to admit it. Seeing as there is very little good music put out by major labels, I don't think I'll miss much.

This is just like stealing satellite TV. It's going to evolve into a cat-and-mouse thing where people find sneakier ways to download music, then the industry finds ways to combat it, repeat ad infinitum.

jujueye 09-10-2003 08:32 AM

Dont get me started abou the fucking riaa. They turn out a crappy product for years, then expect us to buy it by the millions. I cant imagine paying for the rot that is on the pop charts. I'm with the rest of you, and especially with johnnymysto: its only going to get people to go further underground and win anyway. heh heh heh............. go pirates!
