Car Dealership Problems

Hey all, after much consideration, I have decided to come here to ask for help.

On January 31st, I bought a new PT Cruiser from a dealership here in Arizona. I traded in my 98 Ford Mustang GT. After two days, I decided that the car was not for me and gave the dealership a call. I told my salesperson that the car was not what I expected and I would like to have my old car back. He said that he talked to his GM and that I could bring the PT back after I made the first payment and they could try and get me a different car. I said that all I wanted was my Mustang back as there was nothing wrong with it and I really missed it. The salesperson said that he had already been sold to the autoactioneer and that it was off their property.

Jump ahead to February 26th. I was browsing the internet, wishing I had my Mustang back, when I stumbled on my Mustang. It was on AutoTrader and was being sold by the dealership that I had traded it into. Needless to day, I was pissed! After work, I drove down to the shop and confronted a sales manager about this. He said that I did have three days to return the car but stayed firm with the "car had already been moved off the lot" statement.

After 5 hours, another salesman had sold me back my Mustang but for $9000 more than I had originally financed the car for! I was made aware that the PT depreiciated in value as soon as I drove it off the lot, that they had done $1500 worth of work to the Mustang, and that they had to replace the keyless entry as only one key fob had been returned to them. I am willing to pay up to $3000 to make up for this but other than that, I believe I do not owe them anything else.

I am thinking about talking to a lawer to see what my options are. If indeed they had a 3 day return policy, were they just trying to keep me in the PT by saying that the Mustang was off the lot?

I just wanted to throw this out and see what people think. I haven't been able to be approved for a loan on the Mustang since the loan amount is more than 120% of the cars value. I wonder what they will do if I can't get a loan approved for my car? I will try as hard as I can to be with the Mustang and it is by far the best car I have ever owned.

If some of you are wondering why I traded in the car in the first place, it is because I wanted a lower car payment. As it turned out, the insurance for the PT was more than I expected and I was paying more between the loan payment and the insurance for the PT than I was for the Mustang.

Earnharts? I got screwed by them.

And Bill Lukes "tried" and got their truck back.

IMO - Arizona has the crookedest dealers anywhere except North Carolina.

Learn the game. Learn it well.

I'll sound like an ass, and that's OK. If you didn't realize that the insurance on the PT Cruiser was what it was BEFORE you bought the car, you screwed yourself over. That's something that should have been researched before you bought the car. To be honest, you don't really have any options, and you're at the dealerships' mercy.

except that the dealer falsely claimed the car was no longer theirs when it was. They lied to get you to go over the 3 day buyer's remorese limit. I would probably threaten legal action and see what they do.

but in a he said she said fashion. if you truly wanted to rescind the deal you should have held your ground EQUALLY firm to them.

IMHO chalk it up to lessons learned.

well if they're still claiming that, you just record them saying it, then show the judge the classified listing the dealership as the seller

OR do a VIN trace and confirm that it still belongs to the dealership.
