Nissan won't honor their warranty!!
I own a 2002 nissan SE-R Spec V.
The Transmission has recently started making a high pitch whiny sound under duress- I let of the gas, or put in nuetral, and the sound goes away. I have taken the car to <b>THREE</b> Transmission shops and, in every case upon driving the car and putting it up on a lift ( and driving it in the air) I was told that its excessively noisy and that Nissan ought to fix it ( two plces didi ti for free, the third charged me $ 15 for the analysis ( they were all aware that the cars still under warraqnty, so they wouldn't get the job) Yet, I take it to the dealership and they tell me its normal. Bullshit! I know its not. Then they offer to take me out in a new spec-V and compare. Folks, my car is MUCH louder... not even the same. In fact, growing tired of this, I thought I'd just trade it for a honda- AND THE DEALERSHIP WOULDN'T TAKE IT AS A TRADE IN BECAUSE OF "EXCESSIVE NOISE" FROM THE TRANNY!! I have been to EVERY dealership in the Cleveland metro area, and I get the same response! I have called nissan consumer affairs, but to no avail. They just keep telling me to take to a different dealership. I know this sound is not normal, and most guest in my vehicle hear it right away, as well. WHAT SHOULD I DO!!!???

I've noticed this at work... if there is a service issue, here are the things they look at.
1. Did you buy the vehicle from us? 2. Did you service the vehicle at scheduled times, and is it documented? If those two things are true, we try to help people out. I don't see why they wouldn't help you out. How many miles on your car? |

1)I can't take it where I bought it- that dealership is in Oklahoma, I'm now in Ohio.
2) I bought the car new- it only has 25,000 miles on it! although I've had my oil changed when due, I don't do it at dealerships, I do it myself- but that has nothing to do with the transmission. Thanks

What you need to do is the following:
1. Call the General Manager of the Nissan dealership that is giving you the troubles and explain that if the matter is not solved you will make a formal complaint to Nissan that their dealership is giving you the run around. 2. Contact Nissan and explain thet you bought THEIR product and they should stand behind it and if this matter is not fixed in a timely fashion you will start calling the local TV stations and park your car in front of a Nissan dealership every weekend with a sign that says "Don't buy a Nissan they won't back their product" 3. You need to make a complaint with the better business now(gotta get the problem documented. 4. Take the diagnosis form the transmission shops that you have and make a complaint to whomever licenses dealerships in your state. I promise you that if you do these things you will see some response from them. One thing as long as I have been in the car business that a dealer does not want is BAD PRESS or a customer standing outside his dealership on a weekend saying "Don't buy these cars" Finally check your states lemon laws http://autopedia.com/html/HotLinks_Lemon2.html

Are you a qualified mechanic? If so there should be no problem with the Warranty. Is your service book stamped and Ks, date & relevant checks and adjustments ticked off? If so you should have no problem. Do you use genuine parts, filters etc? If so you should have no problem. If you are not following the Manufacturers schedule then the dealership has every right to tell you to piss off. How do I know? I am A Warranty Administrator for 4 different franchises and if the vehicle has not been serviced correctly we will screw you at retail cost. Sorry but that is the truth!

Write a letter to the dealership detailing your entire story. Make sure that you "copy" it (i.e., below your signature, put a "cc" symbol and list the names of recipients) to Nissan itself as well as the Ohio Attorney General.
If you can get a copy of a repair estimate, enclose it (and send copies of that to the copied recipients, too). It's hardball. The dealership won't want the publicity, and Nissan itself will be angry that the dealership is letting it get out of hand....the "can't-you-stupid-dealerships-take-care-of-this-yourself?" attitude. If nothing else, when the transmission fails, you've got documented proof that you TRIED to get it fixed while under warranty BEFORE it totally failed and cost so much to fix. Then take them to small claims court. If you're REALLY irrirated, stand out in front of the dealership with a huge sign that says "THIS DEALERSHIP DENIED MY WARRANTY CLAIM. ASK ME WHY BEFORE YOU BUY." Do it when they're busiest, after 5 p.m or on weekends. |

But the dealer MAY be able to tell ya to screw off if you dont follow the maintenence schedule according to the dealer. They could show that not following the schedule was a deliberate customer act against the car, and is your fault, not a problem with the car. Often times if they can show it was your fault and would not have happened if you followed the schedule, then they can have it not covered under warranty. Sorta like if your engine blows up cause you never changed or filled the oil, thats not covered under warranty.
Kinda sucks, but just make sure you got logs of maintenance and that it followed the retailers intervals, then make some noise and hope for the best
