Obviously suing will not bring your brother back. I am of the mind that if the driver was drunk and/or negligent in any way, he needs to "suffer the consequences." However, if it was truly just an accident, why prolong the pain of your loss?
You can choose to participate or not participate in the lawsuit. Telling your family you support their right to do what they want to do and that you hope they will support your right to not be involved, may be best for your mental health. You are not responsible for how they deal with the death. You are only responsible for yourself! (I know I may sound cold when I say this. I do not mean that you not "be there" for your family. I simply mean, take care of yourself and the rest will fall into place.)
