You didn't say how long ago the accident happened. Grief and pain make it difficult to make a rational decision. Perhaps if you ask the attorney how long the statute of limitations for filing this type of suit is, then you will have a good idea how long you have to make this decision. Take as much time as you can. Perhaps in a year or two you will look at this decision much differently.
The attorney's interests are obvious, and are very different than yours.
