According to NJ taxation committee, if there is no NJ stamp on the smokes, then the wholesaler or distributor has to pay the taxes. If they don't then the consumer has to do so. Every state taxes smokes, they get money from that tax so it really only makes sense that you would have to pay in accordance with that law.

Or it might be in 'discussion'. About a year or two ago, Elliot Spitzer, then the NY state AG, was trying to get the reservations to pay the taxes on their cigarette sales because (at least then), they weren't giving up their customer lists to enable the state to collect that way. He failed. So, now it seems they found a way to get them to hand over those records...
The statement we received lists sales dating back to 05 from just the one place. If this is the precursor-we're sunk; we buy 2 cartons a week.
