Im not real sure because i dont use them but i think most file sharing programs you can change what port they use. I think all your isp would do would be to block ports that are commonly used for stuff like that. Try changing the port to something else.

Yes they are legaly allowed to do that... they are basicly allowed to do anything they want. Same reason why most isps wont tell you exactly how much bandwidth your allowed to use. If you start using tons and tons of bandwidth they will just send you a nasty letter threating to shut you off or bill you more.
