In Maryland every insurer has the right to decline coverage for pre-existing conditions...except for one. Blue Cross/Blue Shield. Called "carefirst" in Maryland.

BlueCross/BlueShield accepted this repsonsibility imposed on them as a result of them accepting certain governement insurance needs, and them becoming the Heath Insurer of Last Resort.

I would imagine it is different in every state.

I think it is definately possible for insurers to refuse pre-existing conditions. I suspect that most states have an insurer of last result. (that doesn't mean it will be affordable).
