web design / site, intell prop. question
...so this is more of a 'what would you do' and law type question. A friend of mine designed and 'admin'd' a website and forum...something like this but not as big. He was sort of the brains and his buddy (partner)was the guy that footed the bill (for the vbull software and server space). Well it now seems as they had a falling out and my friend (designer) is thinking of erasing all the work he did but leaving the vbull software on the server. Well his 'partner' has threatened to call the police if he does this....and is dragging the 'designers' name through the mud...on the site/forum in question. Are there any laws (this is in Canada) you know of that the 'partner' can go after him with....or is he just blowing hot air. Also any other options the 'designer' can do...cause he is really pissed over this whole situation......
anyone know any hacker forums where he can just sort of leave the logins and passwords up....and whatever happens, happens....hahah Last edited by hossified; 12-02-2005 at 09:03 AM.. |

IANAL, but I believe tt really depends on what sort of BUSINESS agreement they had. If it was just a word-of-mouth thing, then no.. the guy can't really sue him for anything. Verbal contracts are shaky at best. If they were an official business operation, like a partnership or a corporation, then him removing his
work would be a tort punishable by corporate law. Whether his partner would actually DO it is another question entirely. The question I have, tho.. is why he wants to remove his work? So they've had a falling out, but is the designer so bitter that'd he risk his reputation and his ethics to screw this guy out of a fancy design? To be honest it sounds really childish....

no there is no agreement (especially in writing)....I think the designer is willing to erase the site, because he would rather nobody use it, than have his reputation bashed on something he built!!! Plus he is being shown no respect at all from the (partner)....and feels as though why should he do any more favours.
