Smith is charged with two counts of aggravated sexual assault. The Crown alleges Smith had unprotected sex with two women, one from Regina and the other from Surrey, B.C., without telling them of his HIV-positive status. They became friends and started having sex several weeks later. At first, he used condoms, but later, as she began to trust him more, they had unprotected sex, she said. At one point, she asked Smith about rumours she had heard that he was infected with HIV, the virus that causes AIDS. Smith denied it and they continued to have sexual relations, she said. The first charge against Smith, in which the alleged victim is the Surrey woman, was laid in October 2005. After hearing news reports about that said Smith was HIV positive, the woman went to have herself tested. Then she went to the police. After she testified as a Crown witness, defence lawyer Marie-Helene Giroux cross-examined her, asking about her criminal record and previous relationships. Credibility, condom use key to case: defence lawyer Outside court, Giroux said credibility and the question of whether Smith used condoms is key in this case. "The Supreme Court says if you have unprotected sex, there is an obligation to disclose. If you have protected sex, there is no obligation to disclose and this is the position we're taking," Giroux said. Giroux said the defence intends to put Smith on the stand. According to an agreed statement of facts between the Crown and defence, Smith is HIV positive and was told so on Nov. 26, 2003 after being tested three days earlier. Crown and defence have also agreed Smith did not inform his sexual partners he was HIV positive. Reporters from media outlets across the country are attending the trial before provincial court Judge Kenn Bellerose, which is expected to last two weeks. Smith, 30, was a linebacker with the Canadian Football League team for seven years. Last February, the team didn't renew his contract. |

There are two points IMO in this case. The fact that he lied to both ladies shows that he had some knowledge of havign HIV and there was certain motive behind not telling them whatever it may be.
The sentence definately fits the crime. He knew the risks of havign HIV and he still continued to have unprotected sex. As said above " "The Supreme Court says if you have unprotected sex, there is an obligation to disclose. If you have protected sex, there is no obligation to disclose and this is the position we're taking," Giroux said. " True on all accounts. The penalty fits the crime. |
