Sex in a Bar Bathroom -- Is It Legal?

ROME (Reuters) - Making love in a bar lavatory does not breach public decency laws so long as the door is shut, an Italian court ruled on Tuesday.

A Swiss couple was accused of committing obscene acts after the owner of a bar in the northern Italian town of Como caught them having sex in the lavatory, Ansa news agency reported.

State prosecutors demanded a six-month prison term for the un-named male defendant and a five-month term for his partner.

But Judge Luciano Storaci threw out the case, saying public decency was not offended because the door was closed.

However, he fined the Swiss man 200 euros ($246) for breaking the lock on the lavatory after he was caught with his trousers down.

"If the barman had given me time to get dressed then nothing would have happened," Ansa quoted the Swiss woman as saying.

Not sure of the legalities, but I can safely say this practice is a whole lot less appealing than it was when I was young and single ;)

if you think about it, a lot of stuff we do is illegal. in some states oral sex is illegal, in others anal sex isn't treated any differently than sex with an animal (in the eyes of the law). until recently, gay sex was illegal throughout the country (it has since been legalized more or less as a technicality in a movement toward legal gay marriages...)

the bottom line is, these laws are virtually useless if you plan on prosecuting anyone and they're only in place because of crazy court cases from 1906. so just remember, if you're in georgia any time soon with your significant other, avoid oral sex at all costs. it's illegal there if and only if the woman does consent. if you're in virginia, don't even think about sex with the lights on. all of you oregon people, no swearing in the throes of passion (if you're a man). don't ask me, ask the legislatures pulling to get these things enforced (or just don't get caught).

Its not all that great a story...I was just flirting with a bf in a bar and he said something like 'how about if i take you into the bathroom and bang you right now.' Well I called his bluff and he led me into the bathroom. It was a private bathroom with a locking door just like you have in your house, no like a big public bathroom. He had me go down on him for a minute or two then he bent me over the sink. Took him about 7 or 8 minutes to finish (he really enjoyed himself). Then we left the bathroom together to quite a bit of dirty looks and some polite applause :)

I think there was a time too in college but the details are hazy...

What is interesting here is the vast numbers of people fucking in public restrooms. i've walked in on people at best buy, bennigans, red lobster, wal-mart, and the community college.

but, i can't really say much because of the things me and my SO do.

Not the cleanest place to do the old in and out but I guess the legality depends on where you live.

Not a bathroom, but ... as a much younger man I was at a bar with friends. Ran into my sister's best friend. I never though much about her one way or the other. Skipping ahead.... Power goes out. emergency lights go on. Man with bullhorn says no need to panic, Bands equipment broke something, lights will be back momentarily. within seconds in a corner illuminated by only an exit sign, I was making out with my sisters best friend. She was the aggressor. She spun be around so my back was to the door and put my hand in her pocket... fumble fumble ... fell backwards through emergency exit. setting off alarms and locking myself, (but not her) out of the bar. I waited near the entrance (not too near mind you) for about 20 minutes, until my friends appeared with my jacket retrieved from an understanding coat check girl.
Neither she nor I have ever mentioned that night ever again.
