Porn, Condoms, and California
linky thing

Also not clear in this article how the fines were determined. Per scene, per video, per actor? Could be interesting. |

Well this should drive the pron industry underground pretty quickly. Kind of a shame really. I doubt that signing a waiver will really help, fact is that if I do something dangerous for work without the proper saftey equipment the boss is still responsible, even if I did sign a waiver stating that I accept the consequences.

Devil's Advocate here?
If I worked in an office building that was wired poorly, or had other hazards, OSHA would be all over the company to get if fixed. It's up to an employer to provide a safe place to work. (I'm a contractor at most places I go, that doesn't negate the employers responsibility to provide a safe place) Why should the porn industry be any different?

I agree with maleficent. Why shouldn't the actors be afforded the same safe work conditions we all expect? I am surprised it has taken this long for mandatory condom use to be implemented. I would think the porn producers would push for this. Sales may take a temporary dip but if all producers have to follow the same rules and it is the only kind legally available sales will rise again.

I personally don't mind seeing condoms in porn; I just don't like that they suddenly appear out of nowhere. (I also dislike when clothes suddenly vanish, or the positions change suddenly. I want to see the transitions). I wonder if condom acceptance in the general population would improve if they fetishized the action of putting on a condom.

But if you are running around a construction site without a hard hat and proper footwear, you are asking for trouble, there are generally signs posted, that hard hats are mandatory. If you fuck around on a porn set without using a condom, your chances of trouble increase exponentially.

I think this is such a stupid issue.
Guys always say "But condoms in porn are such a turn off waaaahhhh!" Well, that's because the only porn you've seen (for the most part) don't involve condoms. If EVERY SINGLE PORN had condom usage, then that would be the norm, right? If that is what you were exposed to from the first time you watched porn then would you still be turned off? I think people need to quit complaining about condom usage and be a little more worried about the individuals health risk who are making porn.

As much as it would be a step toward safety, mandatory condom usage will just push companies to relocate to another state or country. As far as having all porn having condom usage, it's slightly more possible than world peace. We all have or will have sex with our partner without a condom or at the very least expect such day to come so porn with condoms don't exactly portray the sex we imagine with our partners. Because of the difference between our imagination and the condom filled porn we watch alot of people will opt for condom-free porn over the alternative. Thus condom-less companies are at an advantage and little do they want to lose that advantage. So the way I see it the days of all condom porn are so distant away I can't even see them in my imagination.

I figure it will just drive the companies to move to areas where it isn't illegal to film without a condom. This is quite simply because by the argument made for having to wear the condom (protection from bodily fluids), you've just eliminated the money shot, and for some reason that seems to be just about essential to porn :P Add in that it tends to look weird watching someone give a blow job to a guy wearing a condom and I think condoms will be staying out of the industry. Would they be safer if they wore them? Yes, however, I don't see the change happening any time soon, and frankly if you're in porn you know the risks involved with the industry, so you won't catch me caring alot that the actors aren't wearing condoms. Don't like the risk, don't go in to the industry.

Truth is, most infections in porn are not from intercourse anyway; they're from creampie, vaginal and anal. Wearing a condom is pretty pointless if the guy just pulls it off and cums on the chick's face anyway; and the risk of infection from facials is almost zero (unless there's swallowing). Ban creampies before you make condoms mandatory.

dumb question; if the compaines shoot the scenes outside Cali's jurisdiction can they still be held to these laws?
Not that I buy porn anyway, but I honestly would NEVER buy a porn with a single rubber in it. It's bad enough you gotta use the things to get laid-I shouldn't have to see it in my porn. Stars take the risks, just like an electrician takes the risk of being fried so your computer stays on. There's a certain level of acceptable risk in hazardous jobs, and porn is no different. You can't be an electrician and guarantee you won't get shocked. I think the industry does a pretty good job of keeping AIDS out of the workplace, considering how many ppl those recently infected fucked in a two week period. It all started when one star went to Brazil and shot a scene in more risky conditions. Protection is only as good as it's weakness. Condoms suck, but IRL they are necessary. Porn isn't real life, and I'd like my video fantasies condom-free, thanks.

Considering the porn industry is a billion dollar industry that big name companies in the corporate world like Comcast and AOL Time Warner take part in, I doubt the porn industry is going to care about a 30,000$ fine. That's pocket change.
The porn industry is here to stay. It would take a lot more than a measly fine to make them go underground. http://abcnews.go.com/sections/prime...ss_030128.html
