My only question is... if a girl falsely claims she said "no" in an attempt to sandbag you, how can it be proven or disproven?

It worries me because I can see men getting put away on a woman's word alone.

I worry, too. Does regret after the fact count as "no"? And geez - once you've gotten on the train it's kind of hard to put on the breaks. I can see where they'd want to protect people who changed their mind in the middle of the act, but this seems like it would just muddy the waters. It's already very difficult to prove consent/lack of consent when it's a he-said-she-said situation.

Sadly, many of the rape cases already are built on a "he said, she said" foundation. The addition of this law would only make things much harder for the male, and much easier for smear campaigns to be conducted.

I think what needs to be done is to establish a national safe-word, like "Armadillo." Not only would it indicate a desire to stop sex, I think if I was in the middle of the act and a girl started shouting "Armadillo, armadillo!" I'd probably lose my erection.

But seriously, I think that what really needs to happen is that people need to make sure they're comfortable with each other before having sex, and understand what the limits are, and be sensetive enough to each other that they're able and willing to stop if it is requested. I realy don't think there's any way that a law like this could be implemented safely without negative side-effects, like regrets after the fact.

Goodness, with laws like this it is getting to the point where you need a lawyer and a contract before you hop in the sack.

Very sad and scary! What makes it worse, is the girls parents can call rape even if she consented. Not only do you need a contract, you must check id to assure she is over 18! (Which is not fair to the younger male population!) MrSelfDestruct is right on about getting to know each other first -- including her age!

The national-safe word is a good idea because what if the girl answers no to a question while having sex. "Do you want me to stop?" "No." omg rape! I doubt you'd be talking about armadillos while having sex.

Well actually satchitory(sp? whatever ) works both ways if both kids are under 18. So if the parents of the girl cry rape, then both kids are in trouble. This is only the case for under age sex rape, not non consenual rape.(Did that make sense?)
However, if the guy is over 18, he's possibly fucked. Depends on the prosecuter, parents, ages, and other stuff.
When I was with my ex, I was a few motnhs older. Once I was 18 but she was still 17, I was afraid of pissing off her parents for the fact if they found out we were havign sex, they could have brought charges against me. Whether or not they realy would have, I was just nervous.

Like previously stated, I, too, agree with the premise but fear the implications of yet another "rape law." Why don't we just start bagging up all men and shipping them off to prison for life -- starting with the loser that wrote and proposed this legislation (probably male). I also believe that a man can be raped too, but the law doesn't allow for that.

Not sure i have the most understanding for someone who can't come to their senses when a girl cries out "stop" from underneath them. Yeah, i know there's a moment of no return, but i don't think that means the guy has rights to finish if he manages to get it in before she says no.

This stuff just scares me. I am tempted to draft a contract in which it will clearly state that "The woman who's signature rests upon the line below has consented to sex with __(my name)__."

This is the reason why one night stands are bad... well, one of the reasons anyway :p

This is all coming from a California Rape case where two 17 year olds began having consensual sex, and at some point the girl decided she was no longer into it and asked him to stop. Eventually he did, but the courts felt that he didn't stop fast enough. Lurkette regret after the fact is not considered rape according to this law, either party must indicate their wish to stop verbally at some point during the act of intercourse for this law to take effect. If the other party continues sexual relations beyond that point it becomes rape.

Rage statutory rape comes into play when only one of the participants is underage, and the difference in ages is greater than the limit set by the state you're having sex in. In most states it's legal for an 18 y/o to have sex with a 17 y/o, but not a 20 y/o with a 16y/o.

Obviously the male will always be in the vulnerable end of the situation of this .. !
Sometimes this is needed, but many times aswell, the man is marely having a good time with a girl that changes her mind.
