Child support problem
Hey all,
I recently made my child support check come through probation, so instead of recieving it directly from my ex husband, I get it through the probation office by mail. However, there are some problems and I cannot call them since they NEVER answer and do not have a message option in the child support hotline. My ex gets his paycheck divided into 10 months instead of 12( and he gets unemployment in the two summer months). So, what will happen in those two months? In my divorce order, it says that he has to pay $500 EVERY month and the first of each month. Also, now since my check has gone through probation, they give me bi-weekly instead of once a month, and each time is $250. And they take from his 15th day nad 30th day of each month. However, in this process, my paycheck is given in the end of each month instead of the 1st as written in my divorce contract. So, in this month of May, so far i only got $250 and I wont get the other $250 until next month, since they take it the 30th and by the time they send it to me it'll be in June. Deosn't that mean that a whole $500 will be lost? since i'll get the complete $500 of this month's worth, next month. Also, my ex is given his monthly paycheck biweekly and he is given june's paycheck in the 30th of May. that means that May's 1st biweekly paycheck was given on the 30th of april, which in that time they did not deduct anything from that paycheck. i hope i ddin't confuse anyone. i feel cheated. What shall I do? Should I tell my ex to give me this month's paycheck or what? Thanks ofr any help! |

id contact the probation office. go in if you have to, or try to find out who his probation officer is and try contacting that person directly. i wouldn't contact your ex, since you've gone the route of persuing it through a 3rd party, i'd stick to that.
as far as the times of disbursement not matching up to your court order, i'd guess you're out of luck. If anything i'd guess they would make you go back and ammend the order to the dates that probation does check runs if you wish to use that as a collections method -- they're partly doing you a service by being the middle person here. However, if the ammounts don't come out to the same in the end, i think thats a valid complaint, but its something you would need to take up with the probation department. As far as summer and unemployment, at least in my state, if an agency is doing disbursement, they will pay no matter what, and then get their money back out of your ex, either by garnishment, additional supervision fees, etc. |

well wouldn't you just always be 1 month behind? kind of like when you are on payroll you are sometimes 1 whole pay period behind?

I agree with Cynthetiq... it sounds like you'll be getting a check or two after the kid(s) turn 18, and may just have to "deal with it" for now, unfortunately. =(

Just remember, any time you bring anything regarding child support to court that's just another opportunity for him to demand a re-evaluation of the amount payed. As time ticks by, a bitter man person gets advice from friends and dreams of new and improved ways to cheat the system. Just a warning, proceed with caution.
Anexkahn: someone doesn't get a probation officer because they have to pay child support, probate is the just the section of the court that deals with that sytem. |
