Please read, help needed
well, if you saw in the past few days, I had a thread up about my new car. latest update is the transmission is blown. I talked to the guy I bought it from, he said he's fixing it and it should be done tuesday. Problem is, I have to have the car inspected by Wednesday and prove it's not roadworthy to get my money back. Because, after that, the impression I get is he's not obligated to fix it or return it. I'm in Massachusetts, so its all under the lemon law.
ANYONE, please, that knows alot about buying used cars in Mass, or any state, and the lemon law, perhaps mechanics, whomever you may be, please IM me with any information you might have. $1500 dollars is on the line, and any help would be muchy appreciated. A few questions: 1. Have you taken possession of the car, what i mean drove it off the lot?? 2. Have you just given a deposit or signed a CONTRACT also?? 3. Why do you have to have the vehicle inspected by Wednesday?? 4. Did you run a CarFax on the said vehicle?? 5. Is this a corner lot, or a reputable dealer?? 6. The dealer in your state has to give a WARRANTY......BY LAW...what is the warranty?? I will be glad to help you anyway I can. First tip though, NEVER get excited about a car and remember most dealers are snakes and pieces of shit (except me ) Rent the movie suckers and you will see what I mean.

to cover what I didn't cover in my PM...
I have taken possion of the car. In my name, driven off the lot, paid in full with official Bill of Sale. I did not run a carfax check (shame on me) I'm not really sure how to describe the dealer. he seems to be a mechanic, who just every so often comes across a car he thinks he can give a little TLC to and turn it around for a profit. When I bought the caddy, it was the only car he had for sale. It was just in his front yard, but I guess he is licensed as an official car dealer. I got 2 warranties with the car pretty much. one is the pass-inspection warranty. if the car doesn't pass inspection, I bring it to him, he fixes it. The second is the Implied warranty, which I explained in my PM I think the bottom line is I like the car. Alot. It seems to run well, engine sounds fine, everthing works (besides the tranny) and its in great shape, no rust or anything. If I can get it fixed by him, then fine, but my worry is he'll just delay it past the inspection deadline, so that legally he won't have to repair it, or refund me, even though I doubt a court in the world would vote against me. You need to find out if he's a DEALER or has a dealers License. If he has no dealers license then you may be screwed.
Get the car TOW it to an inspection station then to a transmission shop have them do an estimate make sure you get it on PAPER and go form there. If he is not a licensed dealer and just signed over the Title to you it may be considered a private sale. I sent my # if you have require any more help....good luck.

Just out of curiousity what didi your tranny do when it broke down, what I mean did it make a sound,not shift,smoke etc...etc?
Tip: When checking out a new car ALWAYS check the Tranny: A. Drive the car then check the transmission fluid level, feel it and smell it it should be a reddish color and NOT SMELL BURNT! B. Shift the car from gear to gear a few times slowly...especially reverse.(keep foot on brake while doing this) C. Test drive the car to make sure it shifts smoothly through ALL forward gears(make sure you have the radio OFF and windows up)Listen carefully. Cadillacs are good riding cars and are great buys used beacuse they get hit hard in depreciation. Make sure you service it like clockwork. There is a Transmission control module that must be changed EVERY 60K MILES, if you don't change it your car will billow white smoke from under the hood and the car will not shift correctly whle driving. MOST mechanics mis-diagnose this and tell you it's a blown head gasket, when it's just a $40.00 part and 10 minutes of labor. If this is what happened to your car, don't sweat it. Finally, if you don't want the caddy and would like a nice Mercedes drop me a line,we have a clean SL55 for $149,999.00 for sale sorry but in Lost Angeles those cars sell for WAY OVER STICKER PRICE Good luck and God bless

I'd off that Caddie real quick, They have always had problems with overheating when they get old.... plus there's no way that guys going to do anything more than patch up that tranny so it works.
The 4100 was a nice motor when it was new.... but now that it has a bunch of miles on it your're just asking for trouble. I dated a woman that bought one.... it ran fine for about 4 months, then the overheating started..... I replaced the water pump, thermostat, fan switch, and had the radiator rodded out.... it still would overheat on a hot day with the AC on. The 4100 is a aluminum block with stainless steel cylinder sleeves.... it can't be rebuilt, one good overheating and it's shot. I've owned a bunch of Caddies and they were all great cars but they were 70's models... built like tanks and easy to work on, I'd never own a 80's model, they are pretty good cars up until 80,000 miles.... then the problems start. |
