Well it finally happened
No I didn't get laid. Although i did get rear ended, so close enough i guess? My car is pretty messed up as the guy rear ended me going about 20 mph, while I was still. My car then rear ended the car in front of me. The guy who I rear ended wanted nothing to do with the cops and left. The guy who rear ended me accepted full blame and cops filled out the report which i didn't see and left. I have liability insurance and I am wondering what my options are? How do I get this guy's insurance company to cover what it will cost to fix my car? He gave me his policy number, and insurance company code. Any advice is appreciated as this is a 1st for me.

When I got into an accident, my husband (who works at an auto body shop) said to go through my own insurance and let them go after the other guy's insurance company. He said it was faster that way.
I hope you are not hurt. Good luck getting it fixed.

Is the state you live in a no-fault state? If so, it doesnt matter if he accepted blame or not.
To he best of your knowledge, was he issued a summons(ticket) by the police - -if the police didnt see it happen, you did, and you might have been asked to issue a citizens ticket. (I've done that more than once) Call your insurance company immediately if you have not... After the fact, people will change their stories, and you don't want to get blindsided by a sheriff coming to your door with a piece of paper ordering you to appear in court. Generally the insurance companies will duke it out and you don't have to do anything. Call the police station and get a copy of the report. You will probably have to pick it up in person, but the insurance company will probably want to see it, and youwill want to know what has been said.

I am sorry to hear about your accident and I hope that you are alright. I can honestly say that I have never been in an accident that wasn't my fault. But, a couple of years ago I did total my car. I was a little lost and looking at the street signs instead of the stop lights.
Anyway, my insurance was awesome. I called them while I was standing by my totaled little Honda and they walked me through everything. I never heard from the other guy's insurance or him for that matter. I guess I was lucky either that or he was scared of me. I looked pretty pathetic: I was crying and saying I was late for my appointment with my shrink and had to find her number to let her know. I think everyone thought I was psycho, but back to you.... I would call your insurance and let them do the work. That is what they are paid for. If they don't do the contacting, they will let you know what to do. Good luck!

Speaking from personal experience... Whiplash will occur the next day... Go to the emergency room... and make sure that your car insurance company is notifed -- I beleive (depending on policy) your medical expenses should be covered..
there's not a lot that can be done for whiplash-- those neck braces do more harm then good... They will probaby prescribe a muscle relaxant and some physical therapy.

It's been said allready - but also based on hands-on experience
Call your insurance agency and the police NOW! - Don't hesitate - things like this can actually backfire! Get a doctor to give you an extensive exam - some injuries can show over time. By doing this now, you can prove it's caused by the accident -> Insurance coverage. I'm shure you got the message, but MD and insurance angency ASAP PS. Good luck, and have a fast recovery

Took your advice and went to the emergency room. Really glad I did as there was no line whatsoever. The doctor confirmed that i do indeed have whip lash. They did xrays of my neck and it's totallys traight (supposed to be curved a little bit) Doc said it's normal from accidents, and said it shoduld all be fine in a couple days. My insurance is friggin horrible as I tried to contact them right after the accident happened and couldn't get through. I got through today after an hour on hold, and was told that the claim dept is off on weekends, and I should call back on monday. I called the guy's insurance, and was given a case number and an agent's name who should contact me in 2 business days. Not really sure what happenes after that and If i'm eligible for any reimbursement. Went to a body shop today and the guy told me it would cost about 3,000 to fix my car. i was shocked as I was expecting a figure of around 400-750.

My experiences with accidents (which officially on paper number 2) have both been because of my Sleep Apnea. Sounds strange.. but its true. I was the A$$ that rear endeed someone not one time.. but two times.
the first time I was on my way to work and had one of those "long blinks" and when i opened my eyes I was going 40 mph and only about 20 feet from the car in front of me that was stopped at a light. Needless to say, the Geo Metro that I was driving looked aweful and I didnt feel much better. the second time i blame my kids for (but it was reall my fault for not watching the road). They were fighting over a silly $1.50 rubber stretchy toy and i looked back to grab it and take it. Lo- and behold, at the on ram to the highway a car was stopped at a light. (this light was one of those rush hour, red/green ones that moderate trraffic.) so there goes my $14k van and I get the ticket for being an idiot. I feel for the guy that rear ended you .. and was supremely depressed when the guy in front of me said "its my mom and dad's car.. I was on the way to the airport to pick them up" .. I hope the whiplash gets better.. and good luck with the insurance claim. |

Well we had an accident in a no-fault state, with our car only insured for liability. We got the insurance information at the accident but we did not have to contact the insurance company. The company was State Farm. I think our accident happened on a Friday or Sat evening. By Monday we got a call from them. Our car was quite old, a beater actually, and not worth much. It was totalled easily. Hubby asked if they would perhaps let us keep the car though. They were actually glad to since they'd have had to dispose of it which could have been more costly. We got (I think I remember right) about $400 for the car and sold it for another $100 I think for parts. (Just be sure you get a bill of sale anytime you sell a car - but that's another story.)
So moral of the story is - get the insurance information. If they don't contact you promptly, don't wait, contact them and their insurance company SHOULD settled with you fairly. If you don't feel like it's fair, hold out for more. We've dealt with the situation more than once. We actually held out for a year (for various reasons) one time but finally ended up with a fair amount. You don't have to worry about you insurance. They probably won't do anything if you don't have comprehensive. We have comp on one of our cars and dealt with a similar, other person at fault, situation and that is when our company paid and then get reimbursed. You haven't paid your insurance company to be your go between if you haven't purchased comprehensive so don't count on them helping you. Also - go to a chiropractor if your neck doesn't heal up fast. State Farm paid for our chiropractor visits in that same accident and he helped our whiplash clear up VERY quickly. You might have to get another quote for repairs on you car. Unless you have a new car they may end up totalling it because the cost of repairs might be more than the blue book value. Look up the blue book value yourself before the contact you so that you know what you're dealing with.

I don't know if this will be plugging and if it is, feel free to pull it. I got from what you posted that your insurance company isn't all that great. Raeanna mentioned that she had State Farm. I have always had them and they have been great. If you continue to have trouble with your insurance, I would suggest that you try to switch. State Farm has alway been great with us through all our moves and new cars. They take care of everything quickly and we never have had to worry about anything. There rates are pretty good too. Something to think about if you continue to have problems.

mal - I don't know if it's true for you yanks, but up here we're entitled to choose which shop fixes our car. The insurance company will go for the lowest bidder and try to get you to use them, but you have every right to use your own guy if you'd rather.

I'd call them back on monday during business hours and bug them -- not all insurance companies might be fully staffed on weekeds to deal with just fender benders.
When I had my first accident, I was 200 miles away from him, the dude who creamed the back of my car's insurance company travelled to my car.... In some cases, if you are working with an 'approved' body shop, they might not even need to come visit.

I felt completely confused and pissed off and at one point thought I would have to pay for my car getting fixed because of my liability insurance. Thanks to your experiences and with you sharing them with me. I feel very comfortable that everything should be fine.

My mom was rearended while driving my car, and I got a #3500 check to get it fixed ( that was the average quote from 3 shops), I took it to a friend who charged me $2950 so we both got a little profit. Once you get your check, it's your choice where and how to spend it.

This is just great....The adjustor was supposed to come to the body shop where my car is, today. I was witing for a call all day but never got one. Finalyy called the body shop at 1 pm and no one knew what was up with my car, and the boss was MIA. I finally got in touch with the body shop boss at 5 pm, and he calmly tells me the adjustor came, but the boss wasn't ready for him because he had to move cars out of the garage, and the adjustor left. Then he calmly says I could come and pick up my car or whatever, he doesn't really care (his words). Things just keep on getting better. Wouldn't be shocked if he leaves my car outside tonight and it gets damaged even more. There goes the worrisome me.

Take it to another body shop ASAP. It sounds like you could get the runaround from these bozos for a LONG time. I'm surprised the adjustor didn't call you. You should call his insurance company and ask to speak to him specifically.
