Getting sued from selling on Ebay.
 

I posted a lawn jockey on e-bay, like from the civil war era. Any way, I e-mailed the guy and got a returened E-Mail, saying that he was no longer a user of this isp. I was like oh well, not a huge deal I can relist it. Now all of a sudden im getting the e-mails from square trade, and he saying that he sent money and hasn't gotten a product yet. I've never had any contact with this guy other than what he's said through square traid, and I dont want to get into any legal trouble. I'm not going to sell any thing on ebay any more because I dont want any legal trouble because I wanted to make a quick buck on something that's been chilling in my backyard for a while isn't cool. So, would he be able to sue or what? It's kinda scary as i've never had any problem with the law and sure dont want to get dragged into court over a stupid item sold on e-bay. :confused:

What I would do is send off three e-mails. One to Squaretrade and one to eBay, explaining the current situation. The other one should be sent to the guy (assuming he's changed the contact info associated with his eBay account). You might also try getting in touch with paypal or whatever pay system you used, to see if you can return the money, if you in fact received any.

Did you recieve any payment? If not, then I don't think you have anything to worry about, as far as I know, online auctions are a "Pay first, Send it second" type of thing... If he hasn't paid you, and you have the email from the ISP returning your email, then I don't think you have any obligation to send him anything, unless he has a new email and still wants to complete the transaction... but I don't think he can sue you... Of course IANAL, but I think you're safe.

Flippy's right on. Make sure you keep a copy of all emails you send. If he hasn't paid you, be sure to mention that in the email. If he has paid you, you should offer to refund his money or send him the item. If he keeps giving you trouble, post his ebay user name all over usenet newsgroups, describing what he did so if anyone else ever has trouble with him, they'll your issue in a search.

Dude, if he paid you its kinda your responsibility to get him the item, you do know you can look up his contact info including phone number and home address through eBay right? I think sometimes in the world of email we forget that other forms of communication do exist, and its amazing what an actual phone call or hard copy letter can do for a tough situation. If he hasn't sent you money, I'd do the same thing and try to call him, he obviously wanted the item and it'd be stupid if he was on some otehr forum right now griping about how he sent payment but you weren't returning his emails and hadn't sent anything to him. This could all be resolved with a little communication. Email him, email square trade, and email ebay. Tell the whole story, and if you haven't recieved any type of payment make sure to note that. Things DO get lost in the mail, and if he sent a letter with a moneyorder inside this is what could have happened. If he said he paid via paypal you should have gotten an email confirmation, but sometimes that could screw up, who knows. Good luck.

purchaser has three business days to contact the seller and arrange for a money transaction. If you sent an email to his invalid address without him changing his email info on ebay, and he hasn't contacted you, then you have nothing to worry about.

If he sent you a payment without getting in touch with you then he's a total moron. How would he know where to send the money?

The buyer has access to you contact details from ebay. If you could not contact him, then he should have contacted you. If you have recieved no money from him what the hell is on about. I would email square trade and tell them your side and also ask for proof that he has paid as claimed.

If he has not paid he is a moron.

If he has paid and not contacted you he is still a moron.

bermuDa you are exactly correct. This is a scam. Make this guy work and ask him to produce: the receipt for the money order or canceled check, and the return receipt number from the post office that proves he sent it to you. He obviously will not be able to produce these, or copies of them to you, and so will have to go fuck around with somebody else. Seriously, why would he just suddenly not want to be affiliated with ebay???? Sounds VERY suspicious.

Forward any contact you had with him to square trait(or) and tell them to go to hell. Or tell them jujueye says they can go to hell.
