I recently upgraded my cell phone and consequently renewed my contract with service provider. The authorized rep tells me it's done over the mail, but that I could take a phone first and when mine arrives in the mail, to bring it in to his store and we'll be even.
I pay him what i owed him for the phone. 2 days go by and sure enough phone comes in. I take it back to him and think everything is fine. Then I get a phone call from him saying that if his partner calls, deny I got the phone. I do so. Nothing else happens so I figure all dust is settled. I had issues with service provider and call only to find out I have 2 instances of insurance fraud on my account. What had happened was I did my phone upgrade and paid 100. The authorized dealer I went through apparently took my 100 and used 50 of it for the insurance deductible to get a phone more expensive than what I got. Then because he scammed out his partner, his partner called in insurance again and got another phone also. Now service provider told me it was shipped to some address in Rosemead but won't release anything else unless I subpoena it and they won't remove the fraudulent activity on my account. The rep later offers 2 months of service credit as a consolation. My question, what legal action can be done since their authorized dealer used the information in my account to fraud insurance and now it's on my record. I want to find out before I start being assertive with them. Thank you.
