Trouble with court
I got in trouble with the police back in September 04 for trying to purchase alcohol with a fake I.D.
In october I met with the clerk magistrate of the court and he agree'd to order a continuance of court until may 4th, when it would get dismissed, as long as I did not get in any trouble again, and I attended an alcohol program by May 4th. I was told the program would send me information in the mail. I never recieved any information from them in the mail, but I called the court and recieved a phone number for the program. They said they had sent out a notice and I missed it, and that they would send another notice. I had to pay a $30 fine for missing the first program. I recieved the next letter in December which said I had to attend the program on February 16th. When I got back to school after winter break I found a summons in my mailbox. I appeared in court and because I had missed my first program I had violated my conditions. I informed them that I had re-scheduled and they agree'd to grant the dismissal as long as I attended the program and payed a $100 fine. I sent a certified mail to the court with my information and a check for $100. I recieved notification that they had accepted the mail. I attended the program on February 16th, signed in my name and filled out what they needed me to fill out and I thought everything was all set. Today I recieved another summons in the maol requesting for me to go to court. The summons was issued on february 16th. I don't have the information yet, but I have to assume that the court never got the letter from the program saying I had attended. There is no way the court would have gotten the letter in time if the issued the summons the 16th and I attended the program the 16th. I have a receipt saying that I was at the program, but I think this is completely unjust. I have not violated any of the conditions and only due to the error of court and the alcohol program have I had to pay additional fines and miss classes. Does anyone know if there is anything I can do? |

Present COPIES of all your documentation to the court when you appear. When you talk on the phone, record who you spoke to, the subject and what time and date. (If possible, get everything in writing.)
Hopefully after you present all your information to the judge and explain it to him, he should dismiss everything. Worst case, get a lawyer. If you are a poor college student, check the phone book for the local legal aid society and they should be able to help you.
