I used to work at a movie theatre and we would give them away pretty much to the first person who asked (once we were done with them that is). I can't imagine that video game standees are all that different, where would they go?
My guess is whoever you talked to at EB didn't know what's what...talk to the manager.

We have a few here at work. Most guys who have them got them from EB or someplace like that. Best buy even has them around sometimes, check there also.

I also, have worked at a movie theater, and desired to get some of the standees, and sometimes have run into the trouble of 1)having to return them to the distributor (as strange as it sounds), or 2) somebody else (i.e. the manager him/herself or the projector worker) has already called dibs on them. It's hard to get that kind of shit sometimes. But, the others are right, talk to a manager and see if they know what the deal is, because I've strangely enough, also worked in a retailer that carries a good selection of video games and gets all kinds of standees and other free shit from manufacturers (watches from SCEA, shit tons of stickers from Nintendo for Metroid Prime, posters, and more t-shirts than you or your grandfather could handle.) But, most of that stuff gets taken home at the end of an advertisement cycle (by guys like me who work there. ) What I'm trying to really get it as, just ask a higher-up about it, they'll most likely give you a straight answer.

As an employee of EB, I can tell you for certain that we do NOT send them back, that guy was just trying to blow you off. Most of the time, either an employee takes them home, or they are thrown out. Technically we aren't allowed to give them out to customers as they try and sell it on ebay, and that's against company policy.
