EB Games selling stolen goods.
I was amazed when I read this story about EB Games. What a bunch of tightwads or should I say assholes...

So they have to give her the money because they bought her (stolen) merchandise unknowingly? The thief has the money, he should pay. Wtf is up with that?

As I read this article the only thought that went through my head is that this has been going on for years. If anybody thinks that this is a new phenomena, then Ive got some ocean front property to sell them. I've known quite a few druggies in my day and they would be ballsy enough to go sell stolen stuff to places that required them to show thier ID. This is gonna continue no matter how much the press tries to turn up the heat on these businesses. As far as EB is concerned, they should step up the plate, and just replace the girls property with new equipment. Its a simple jesture that wont really cost them all that much.

I just think that if I had a bunch of stolen games and the cops found out, I'd be going to jail for possession of stolen goods. These guys can just say "Screw you" to the lady. If I tried to sell back the stolen stuff to the lady I'd be in BIG trouble and they can get away with it. Pisses me off.

They are at fault because they broke the law. She should get her stuff, and EB should be the one that has to worry about taking care of the money they squandered because of a theif.

This reminds me of a time about four years ago a friend of mine(not much of one) stole a bunch of my games and sold them to a local vido store. I went there and found the games and he had signed his name on the receipt thing so I knew it was my stuff. She told me I had to get the money from him and buy them back from the store. I should have called the cops, but I got back some money, not enough to buy back all my games mind you.

That's bullshit. They should be giving the shit back to her and they should be trying to get the money back from the theif. They make a shitload of money AND they broke the law. They should give the stuff back to her and replace the stuff she sold with similar used equipment.
I've never bought anything from them. Now I won't buy anything from them in the future. I'll also make sure that every person I know who buys gaming stuff knows about this story. If they would have given her the stuff (even if it was just the stuff they had left) they could have made a customer for life and got good pub off of it. Now they look very bad. |

Here's how we handle it in my jurisdiction:
When we discover stolen goods, we have the store return the items to the original owner. Then we charge the suspect with two thefts: The original theft of the items and the theft of currency through deception from the store. Then the store usually sues the suspect for the money that they gave him/her for the stolen goods. |
man if that shit happened here in louisiana.. someone would get an ass beatin after the store closed..
but lets see.. by law.. any store responcable for selling stolen goods runs the risk of trouble.. trafficing in stolen goods can mean a yank of your store lease and such.. happened before.. pawn shops run that risk all the time. the thing that sucks is this.. if she had any puter games she had with a cd key are runined.. lol but the one thing about it.. if she has the serial number off that playstation.. they are fucksoar no matter what they try. .. cuz those places are supposed to get a address of the people selling and buying the pricy stuff.. or they should if they dont man that is annoying |
i could be wrong, but..i think the way liability works, the woman can sue the thief for the stolen property for the amount it is worth (in this case, the amount that EB sells it for). EB is not liable to anyone (though they did break the 15-day law) since they purchased the goods in good faith, not knowing it was stolen (or we presume so). The idea is that everyone gets exactly what they should get, but you skip the middle man. However, you still need to get a lawyer and go to court for all this to happen. it's a sucky system, but it keeps you from situations where the thief sells to person A who sells to person B who sells to person C, etc. etc and you have to get everyone involved in giving the person before the money due.
