Granny Better Watch Her Ass In Florida

link

OK, all you senior citizens dragracing your Buick Regals to the AARP meetings-knock it off!
As of October, any drivers accused of dragracing on public roadways will lose their ride for at least 10 days without due process. "The legislation only defines drag racing as comparing the speed or power of one vehicle to another vehicle on a public road or in a parking lot, "at accelerating speeds in a competitive attempt to outdistance each other." The penalties apply regardless of whether anyone was actually harmed or threatened with harm from such a contest."
I have a car that, when I downshift to pass, gets loud, which in turn usually causes some kid in his 'work-in-progress' to try to race me. I'm not racing, I just like to pass and get out of the way....would I lose my car for that in Florida? As that stands, probably.

Please refer to the movies "The Fast and The Furious" and "2 Fast 2 Furious" to understand why the state of Florida passed this legislation.

As a child of Miami I can tell you that there is nothing like kicking a car up to 170mph on I95.

In Canada (BC), you can get pegged for that too, even if you're doing under the speed limit. "Excessive acceleration".

My very first ticket was for drag racing. I wa driving a Honda750, my buddy was diving a 125. Even though we never exceeded the speed limit, the officer insisted we were racing. I brought comparative power specs with me to court, but the judge wouldn't hear it. A 16 year old didn't stand a chance in hell of winning that one. These days I generally get a warning ticket, when I'm actually speeding. Age has it's advantages.

The police can also immediately seize a car used in a race for 10 days without due process for the first offense. On the second offense, police can seize and sell the car used, regardless of its value.
I'm sure that Jeb Bush wouldn't dream of signing into law an extension of the government's seizure laws while eliminating a check on legal authority.

This is a huge deal down here for us younger people. I am in a domestic car club...and about half of us have been arrested or given tickets for tires spinning in the rain. Everyone with half a brain will realize that a 450 hp rear wheel drive car is going to spin in the rain. A few of them have lost thier licenses..they just can't afford a good lawyer...and the judge isn't going to take the word of some 18 yr old kid ove the police. The law here on street racing is very vague, it gives the officer the choice of what is and is not racing.
Our club is currently writing letters and calling our legislators to have something done...out of like 100 people, we received one response...she was on our side on the issue. I am sure, since we are young people, and we are notoriously bad voters, the policticians could care less about what effects us.

Veruca, if you haven't already you may want to try and get the ACLU involved. From what I have read on this, this law seems to be stepping all over property rights and unchecked authority given to police written purposely ambiguous. I wish you luck and I hope that people in Florida open there eyes on this...

Additionally, I vote for the impeachment and/or lynching whoever wrote the law prohibiting "Exhibition of Speed." In some areas, something as simple as revving your engine at a stoplight can get you a ticket with the same penalties as racing, even if you'r estanding still. Other offenses include screeching tires, losing traction around a corner (the previous two still apply in rainy condidions,) accelerating excessively, a nitruos purge anywhere but a racetrack, excessively loud exhaust, and a whole bunch of other crap.
