Living will information for people in the USA
In light of all the talk lately on DNR's and Living Wills....
Here is a website I found that tells you, according to your state, the laws for having a living will....for example, in Georgia (I havent looked at other states) you do not have to have it prepared by an attorney, you can fill it out yourself and sign it in the presence of two witnesses, as long as they meet "witness" criteria. I had one, but by law in Georgia, when you get divorced its automatically revoked from your husband (if that is who you named)....and If it wasnt your husband that you named, its revoked upon any REMARRIAGE you may have, since GA law says a spouse's decision overrides your paper So I will be filling out a new one due to the divorce and since I am single until October. http://www.vistacare.com/hospice/too..._documents.php I thought this might be useful to some of you

I was talking about this over Easter dinner with my attorney father and mother, much to my sister's chagrin (they aren't going to die anytime soon) I am executer of their estate but honestly didn't know what they wanted. I know now and am Ok with their choice, and will carry out their choice when the time comes.
I brought up the fact that I had a living will, a DNR, and a will for quite some time. My dad gives me a quizzical look and says, my office didn't prepare it did they? Nope, found it on the internet, and had it witnessed and notarized. He kinda coughed a bit and said, well... and this was not as one of those money grubbing lawyer types talking either -- he said you want to make sure it won't be overridded... have it done by a professional... The internet forms really aren't all that ironclad.

This is the exact same form (for georgia anyway) that I paid money for in a legal packet years ago.
I have also talked to a lawyer friend that says there is no reason to pay a "lawyer" money to do this particular thing. A regular will....sure you'd want a professional, but in this case doing it yourself is fine. but what do I know....I did my own divorce cause I didnt wanna pay somebody 400 bucks to do what I could do for 80

Thanks ShaniFaye for the info, it is very relevant and good to know. And thanks Maleficent for the caveat, we should all do our research, double-check and be responsible for ourselves.
To add, I think nolo.com may have info too. Also, in todays Yahoo! - http://biz.yahoo.com/special/livingwill05.html |
