ANGLETON -- A Brazoria County man was given probation for injuring his two stepchildren with a stun gun but sentenced to two years in a state jail for endangering his two birth children.

The jury said Friday that Theodore Moody, 27, should serve six-, three- and two-year probated terms for injury to his 8-year-old stepson and 11-year-old stepdaughter. The panel had convicted him Thursday.

Retired state District Judge J. Ray Gayle III, a grandfather, sentenced Moody to state jail for allowing his children, ages 3 and 2, to wander unsupervised around their Sweeny-area neighborhood wearing only dirty diapers.

The defense had asked that Gayle sentence Moody on the child endangerment counts.

Gayle said he wondered during the weeklong trial if Moody was stupid or mean. "I concluded that you weren't dumb, you were either mean or just lazy," Gayle told Moody.

Jurors refused to talk to reporters, but said several had shocked themselves with the stun gun while deliberating Moody's guilt or innocence.

They handed Moody a six-year probated sentence for shocking his stepson six to 10 times while he marched him five miles toward school after the boy missed the school bus.

He got three-years probation for shocking the boy after the lad took a soft drink from the refrigerator and two-years probation for shocking his stepdaughter for dropping hot water on her 2-year-old sister while she was cooking.

In each charge, the jury found that Moody was eligible for probation because he had no previous felony conviction.

Gayle noted that while Moody was severely disciplining the 8-year-old for not properly sanding a car he was working on or mowing the grass incorrectly, he was allowing the two younger children to wander along their unpaved street unsupervised.

"You went way over the line," Gayle said.

He said all the sentences will be served concurrently, meaning that in effect, Moody will serve two years in a state jail and then serve four years probation.

Prosecutor Don Stricklin said he was pleased with the judge's sentence, noting that Moody cannot be paroled on the state jail term.

Court-appointed defense attorney Joseph Varela said he will appeal all the convictions.

"I'm a good person," Moody sobbed from the witness stand as he asked for probation. "I screwed up."

He said he no longer lives with his common-law wife, Tsianina, but added, "I'll never stop loving her and I won't ever be with somebody else."

The pair split up, he said, so she will have a better chance of having the four children returned by Children's Protective Services. Tsianina Moody is to be tried in July on similar charges.

Moody said he thought at the time that disciplining his children with a stun gun wasn't excessive, but that he came to understand during the trial that shocking them was unacceptable.

"I'd give anything to write to them right now," telling them he is sorry, but they have been taken into state custody and he may not contact them.

Gayle said he will formally sentence Moody on Monday. Until then, he said, Moody can remain free on bond and while his convictions are being appealed.



I am a firm believer that not everyone should be allowed to have kids just because they can.
This is a perfect example why I think that.
This dickhead should be locked up for more than 2 years. The thing that really pisses me off is I just posted an article yesterday where a kid can be tried as an adult and get 5 years in jail for feeding a cat to a gator. Can anyone actually say that what that kid did was worse than what this man did? It's a no contest in my book. The man is way worse. Just imagine how bad he fucked these kids up.

While I agree it is unfortunate that anyone may reproduce, it's impossible to decide who can and who can't. There's no one I trust to judge me, and I don't trust me to judge others.

I think we are headed towards a future where a couple will have to show they are economically prepared to support a child before having one. I'm not saying that's good, but go ask the Chinese about overpopulation.

I wouldn't have to look long to find more examples of people being punished more for less heiness (sp?) crimes. Remember, here we are comparing the punishment one person received with the what another only faces.

I'm still pissed about the boy killing the cat and it personally bothers me more than this ass. But I do think what this guy did is worse.

A society has a responsibility to ensure its continued survival at whatever standards it chooses. I'm looking forward to the day in which we begin to enforce reasonable standards upon the "right" to have children.

i agree that not everyone should have kids, but the thing is...its the dumbest of us (ussualy) that have the most kids...you dont see reponsible pearents with more the 3 or 4 kids at the extreme most

sixate, I agree with you 100%.

I work in retail selling pets to families. There has been MANY times when I refused to close a sale because the would-be pet owner is a dumb-ass that can't grasp what responsibility pet ownership entails. And yet, they have their kids clinging to their pants screaming and crying.

I won't sell them a dog but they are allowed to breed?????

What really gets me is past the excessive punishment is WHAT he was punishing them for ... having an 8 year old sand your car? If my dad asked me to do that now I would laugh at him. Or even mow the lawn.. He is 8! I wouldn't want my 8 year old son even near that spinning blade.

i use to believe that a person should not be allowed to have a child without a license until a friend politely showed me how fast that would fail because ultimately the poor would not be able to afford the license and not populate while the rich could and would and can probably buy the license if they are capable or not. Money makes the world go 'round.



as for the son of a bitch with the taser gun, i say use it on him five times a day for 30 years minimum. he should be executed in my mind, i have zero tolerance for this type of shit.

No person has the right to abuse others, especially mostly if not totally defenseless children.

what kind of fuckwit do you have to be to taser a CHILD?


his death will not make the pain easier, but it may discourage others that may do this. this shit has to stop...

I would agree with that statement. It's an easy thing to let your emotions take over and demand that "something be done to stop this madness". There are questions that need to be answered before we allow ourselves to start a long dangerous slide down this very slippery slope.

(1.) How, and even more importantly, who, gets to decide who, and who does not, get to have chidren?

(2.) What critera would be used to determine the fitness of a parental candidate?

(3.) Would mandatory birth control be enacted, and if so, how would it be enforced?

(4.) What penalties would be enacted for an "Unauthorized Pregnancy"?

(5.) At what age do you require manatory birth control?

(6.) Do you enact forced abortion if you are under the "Legal Childbearing Age", or become pregnant outside of the predetermined parameters?

(7.) If financial ability is of concern, what is the minimum amount that you can earn in a year to qualify to have children?

These are just a few questions off the top of my head. Every answer to every one of those questions raises hundreds of more questions. The only real question is, do we really want that much government interference in our personal lives? Anyone?

Bill O' summed up many of my thoughts on the subject, so I'll just repeat my belief that it's a slope you don't want to go down at all. Reproduction is the most fundamental right anyone has. You're born, you fuck, you have kids, you die. Wash, rinse, repeat. Start taking that away...I don't want to be there. ::flashes a quick grin::

1. I'll gladly make all the decisions on this, but nobody would like my decisions.

2. There would be many. Money, environment, and just how damn smart you are would only be a very small start. There are a shitload of things that people should be able to provide. If an adult uses drugs and drinks then they have no fucking chance to ever have a kid.

3. No need for mandatory birth control, but If people aren't smart enough to use condoms and get on the pill and they don't meet my qualifications then abortion is the only option.

4. Immediate abortion and fine.

5. Like I said. No need for mandatory birth control.

6. Fuck yes!

7. That would depend on where you lived. Cost of living is different everywhere. If you live in a shit neighborhood then you should never have a kid.

I have no problem with the government regulating who can have kids. Too many people are fucking dumb and have kids who they can't take care of which results in even more fucked up adults. Just so you know. I wouldn't pass my own qaulifications to have a kid. I know I'm not ready.

I think it's better than mommy and daddy living half way across the country from each other and one or both parents hardly being a positive influence on their child's life. The odds are against kids in those situations and it's totally the fault of irresponsible parents who weren't smart enough to use birth control because they didn't realize that they weren't capable of rasing a kid properly. It'll never happen so there's really no need to worry about it.

that's fuckin' CRUEL, sixate. Tell ya what, when you get pregnant, and then are forced, against your will, to have that child killed, THEN you can talk about mandatory abortions. Until then, you need to rethink your policies, 'cuz all you're gonna do is create a shitload of depressed, emotionally damaged women. Having the CHOICE of having an abortion, and forcing it on someone are two VERY different things.

And another thing. If I have a beer this weekend after I"m done moving, does that mean I can never have a child? or do I have to be an alcoholic? If I smoke weed once, am I disqualified? or do I have to be addicted to coke? Who defines when I'm addicted or not? Who keeps such close tabs on my personal life? who says that someone who smokes weed can't be a good parent, for that matter?

This dad, he's horrible. I have no respect for parents like that. but what we're doing now, punishing those who do wrong, that's about all we CAN do. There's no such thing as pre-emptive crime-prevention. It just can't be done, so, we do what we can, and kick the ass of people like this guy.

I know it's not a popular opinion and I won't be running things soon so there's really no need to get upset. Sorry, but I've seen way too many people really screw their kids lives up because they'd rather go have a drink and smoke some weed. Parents should have more important things to do that stuff like that. When/if I ever have a kid I'll never have any of that crap in my house. Again, it's only my opinion and there's no need for anyone to get all fired up about it because it'll never happen.
