Dumb lawsuits that people won
I have heard a couple lawsuits that the person sued a company and won even though it was their own idiotic behaviors that caused the problem.
A guy was driving a motor home he put the thing on cruise control and went back to make a sandwich. The vehical went off the road and he was hurt. He sued the company for a million dollars and the cost of a new motor home because it didnt say in the manual that you couldnt leave the steering wheel. Now the manual states cruise control still needs person driving the vehical. Aother woman won a lawsuit against Burger King. The mother took her children to Burger King for supper everyday and because of it her children are now overweight. She said that no one informed her that her children could gain weight from eating so much fast food. A woman walking through a store and triped over a child in the middle of the isle and broke her leg. She sued the store for negligance and won. The catcher was it was her OWN child that she tripped over. |
I have heard all of these and many, many more. I took a business law class several years ago and learned how smart really stupid people can be. If you can make $500,000 for breaking into a warehouse via the skylights, falling and breaking your leg, and suing the company for lack of secure locks on the skylight windows, you are pretty ingenious in my book.

The one that pissed me off the most was when some lady sued McDonald's because she burned her lip on a pickle from a FRESHLY made cheeseburger. Oh My Gawd I wanted to sock that lady in the face for being retarded. I still can't believe she won that case too.

This kind of thing happens all to often. Hopefully it will come to a quick halt, but unfortuantely I don't see that happening any time soon, or ever for that matter.
|
how the hell do you burn your lip on a pickle, i thought that it was coffee, anyways yes all those law suits are fucked up.
only in America can you get rich off your own stupidity |
I heard there was a coffee and pickle lawsuit but I could be wrong. Either way, they are gay.
|
They may be stupid, but now their rich. I think it's time we all try to find loopholes and the such to exploit companies and get rich quick

It may be just me, but if I'm buying coffee it's because I thought it was hot, not cold... And I don’t know what the 2nd lawsuit was about. :( Quote:

When my Dad used to work for Stelco when he was 18. He heard of stories such as some workers, during the break, like to go on top of the roof of the factory and go naked to get some tanning done during their break. But a supervisor found out that this was happening and suspended them all with no pay. As a result, the union sued and threaten to go on strike. As a result, the guys that were tanning ended up still suspended, WITH pay.
Ya gotta love unions! :D |
I know I started this thread But spived2 said it best.

You usually buy coffee to drink it right away, and therefore keeping the coffee so hot that you would burn your mouth and troath is not reasonable. Quote:
I like people who Google. |
You think I could sue God for making me short?

*shrugs* I was wrong, I was going off of memory of what I read in the papers years ago. I thought I was right, next time I won't state memory as fact till I google it... *shrugs* Also, don't you have to heat the water to a boiling point to make coffee? Perhaps the woman had a fresh cup. The boiling point of water is 212 degrees Fahrenheit. Still even if the pot wasn't fresh more than likely it was kept on a warmer to keep the contents hot. I'd think most people would know better than to put a cup of something that hot in their lap because something like this could happen. Most people I know buy coffee because it's hot and they blow on the contents to cool it off before they drink it. |

Something like what could happen? Usually coffee isn't hot enough to give you third degree burns in two to seven seconds. If the coffee would have been just a few degrees cooler she might not have gotten those burns, not to taht degree anyway. Any suggestion where she should have put her cup, in a car, when trying to open it to add milk and sugar? |
lol- what people do to get money. Too bad they have not only made their own lives miserable (because you know they are still not happy) and that they choose to blame someone else for their actions.

The motor home thing with cruise control is a myth. Pure and simple myth.
And that lady with burns from McDonald's coffe, won because they were able to produce internal memo's and study's that serving seriously scalding hot coffee masks the taste of crappy coffee. McDonald's made a hell of a lot more money on that law suit then the lady. Even disregarding the huge reduction applied by a court of appeals. I am all for lawsuits of all kinds, frivolous or not. I AM NOT for namby-pamby give away the bank juries who don't use common sense. Here's a Jury award I'd like to see: Plaintiff gets: $1.00 Plaintiff's attorney gets zero. NOT EVEN 1/3 of the plaintiff's award. Contract between Plaintiff and attorney, voided. Plaintiff's attorney is required to pay all court costs. Defendant attorney fees to be paid by the plaintiff. :) Reasonable verdicts like that one on frivolous lawsuits would quickly...stem the tide of these actions. -bear |

God bless lawyers huh? imagine what a world without lawyers would be like... a happy place? o_0;;

Frighteningly enough, my favorite local cop said the same thing- course I run an archaic weapons shop outa my house, so its gonna be a hell of a police report if I have to kill an intruder.....

Here is one in which I was personally involved. Responding to a fire, with my lightbar on, the night was snowy, so I was taking my time. As I approached a T intersection where I would have to turn left, a vehicle approached from my left. I slowed and stopped 10' short of the stop sign, as the other guy had the right of way. He slammed on his brakes, left the roadway, ran over a few bushes and hit the left front of my truck. Then he sued me for being 'negligently stopped'. His reasoning was that he 'expected' me to run the stop sign, and when I complied with the rules of the road, I was therefore contributory to the accident.
My insurance company paid him. I changed insurance carriers. |
Haha, stupid Americans!
What, it's true, admit it! Stupid! LOL ;) |

Yeah .. then it's the situations that deserve to win that don't even come close to winning what the person should have won because of all these other people who sue for such trivial shit.
My son rode his bike thru a business parking lot and rode off the edge and after invesgiating his story I was a little pissed and took the company to court. One..the parking lot was like an obstical illusion and you couldn't tell it dropped off unless you right up on the drop off by then I could understand he didn't have time to brake. Two..the other side was another business parking lot and in some places of the drop .. of course where my son went off at was as high as the hood of a car. But I think the real jerker for me in which I took the company to court for was my son broke his collar bone in two places because of this and his friend and my son went into the place and asked if they could use the phone and the manager told them no. I called this manager and asked if this was so and the dumb ass admitted it and had nerve to tell me that if they needed to make a call he would have loaned them the money for a pay phone, that the phone was business puposes only. It was a liqour store. Now please.. come on .. I asked that man if someone would have been shot in the lot if he would have called 911 and he said yes ... I then asked him whats the diffrence someone bleeding on the outside and someone possibly bleeding on the inside, in which we are very lucky he wasn't, and he didn't have much of an answer thats when I made up my mind if my son didn't heal right and it lead to surgery I was going to sue. In which it did and which I did and we came out 2 thou shy of paying all medical expenses. Now my son has a metal plate... 9 screws and a wire holding his collar bone in place.. lost out on football.. and who knows what problems it will bring in his future and the kid didn't even win enough to pay for the doctor bills let alone problems that may occure. Why? Because of all the people that sue for pitiful reasonings and we got drug thru the system and made to look bad. I think the company should have been held accountable for more of their responsibility in this because they had a stupid manager. My kid walked two blocks with his friend pushing their bikes to a gas station close by in which they called home and by the time I got their evidently the gas station felt it was serious enough because my son kept knodding off they called an ambulance that pulled in at the same time I did. So now comanpies get off easier because of pickles and coffee. |
i really dont know what disguists me more, the fact that people sue others for stupid shit, or the fact that it holds up in court and they win
out judicial system is SO FUCKED UP, as well as society is too. people are just as selfish and greedy as they are stupid. i really dont know how much longer society can stand to live like this before we just fail as a whole. |
