The lesser of two evils?
 
At a loss for words with this other than to say that crap attracts crap.
He knows the guy so maybe there is more to it than is reported.

There are issues here.
The 16 year age difference for one.
He knew the guy for two.

I am only observing from a distance but something is seriously wrong here.

TROY. A 20-year-old man burglarizing an apartment pried open a tackle box and found nude photos of young girls, including his little sister.

The man turned himself and the pictures into police, who later arrested the apartment's tenant, a registered sex offender now facing a possible life sentence after being charged with rape of a child under the age of 13 and illegal use of a minor in nudity-oriented material.

Police said the rape charge against Richard Yearsley, 51, involved sexual touching in March of a child who was just under 4.

The 20-year-old man told police he watched Yearsley, whom he knew, leave the apartment and broke in once he left. Police said he then became enraged when he saw his 4-year-old sister's picture among "numerous" Polaroid photos of nude or partially nude young girls inside the tackle box.

He showed some of the photos to the building maintenance man, who convinced him to go to the police.

Police then searched the apartment late Friday and found photos of other young children in various states of dress.

The man said he knew what he had done was wrong, but "he knew that Yearsley was involved in something much worse and had to be stopped," according to the police report.

Police said that Yearsley admitted to taking photos of four other children during the past couple of years, and sexually touching some of them.

Wayne Willcox, deputy Piqua police chief, said the 20-year-old's case was referred to the city prosecutor to determine what charges will be filed.

Yearsley was registered as a sexually oriented offender with the Miami County Sheriff's Office following a 1995 conviction in Miami County for felony gross sexual imposition and disseminating matter harmful to juveniles.

Bail for Yearsley was set at $150,000 at arraignment Monday in Miami County Municipal Court.

Yearsley's preliminary hearing is scheduled for next Tuesday .

The Dayton Daily News is not identifying the 20-year-old man in order to protect the identity of his sister.

If I was the 20 yearold breaking into somebodies appartment and found pictures of my sister like that, I would have waited for the guy to come home and severly beaten him. I can't get over how messed up people are. I f there is one thing thatdrives me insane, it's hearing about child molesters and pedophiles.it makes me so enraged that these people exist.
On the upside, when Yearsly gets to prison, he will quite literally have a new asshole torn for him.

Dicey legal situation here.

Laws differ from state to state, but - unfair as it may seem - I think any material found under a search warrant that was the result of the commitment of a felony will be thrown out of court, along with his subsequent confession. I think the police will have no case.

I sure hope you're wrong. But the police said "Yearsley admitted to taking photos of four other children during the past couple of years, and sexually touching some of them." So I don't think they'll have a problem putting him in the slammer. And they should slap on 20 years to what ever they're giving him...4yr olds... that is just insane...

Hmm...you've got agood point. I didn't even think of it like that. I was to busy thinking about the guy going to prison straight away. Hopefully they can find a way to bring him to justice.

It sounds to me like the "burgler" had suspicions, so used the burglary as a front to confirm said suspicions.

Previous conviction. How long can probation be for a felony? Does the case even need to go to court? Can an admission of guilt without any charges result in arrest and prosecution?

I would have probably left the guy half left if I was the burgler. Wonder what the punishment should be for the burgler. For the guy who took this pictures I'd have him put away for life but that probably won't happen.

You know he might have started out doing wrong,
but he ended up doing right.

Yes, he broke in
Yes, he could have easily attacked the man
But, he turned himself in, and got a worse human off the streets.

And if he knew about it ahead of the break-in, oh well.
That's a bit of vigilante in him...he could have gone further, but didn't.

He'll serve his time, but in the end he did better for himself, his sister & society.

I'm with Guttersnipe. Lay in wait until the loser comes back. Beat him within and inch of his life. Take the rap for a B&E and a felony battery. You're out in 2-4 (maybe a few more depending on how bad you beat him). He gets his ass beat AND goes to prison for a while.

Sounds fair.

sitting here I cant honestly say what I would do if that truely happened to me. I dont break into houses in the first place but to be in that situation would be tough. I would probably cause quite a bit of physical harm to the molester but theres really no telling what you would do in such an extreme situation without actually being in it.

my thoughts exactly, seems all a little to coincidental, his sister may have suggested something, but you'd think he would have just waited with a baseball bat for the guy to come back and shove it where the sun don't shine. In cases like this a bit of personal revenge and then police intervention seems reasonable :) my .02c

The charges will probably stick to this loathsome creature no matter how the photos were found. It is a registered sex offender and I'm pretty sure the restrictions placed on it's probation prohibit child pornography. Possession is awfully damning. Good riddance.

I'm surprised he gave himself up to turn in that guy. I would've expected he'd have just ignored what he had found.
The story almost sounds fake..... why would he look in a tackle box !?

All the more reason your course of action would have probably been the best course of action; though a little on the forgiving side.
