SAPULPA, Okla. -- A convicted rapist has been sentenced to life in prison for spitting on a police officer.

Creek County Associate District Judge April Sellers White followed the recommendation of a jury for the maximum sentence against John C. Marquez under a law that makes it a felony to place bodily fluids on law enforcement officers.

White rejected a prosecution request for a 25-year prison term and a defense request for a four-year term.

Following sentencing Monday, Marquez's attorney, Jason Serner, promised an appeal to the state Court of Criminal Appeals. No appeal had been filed by today.

Marquez, 35, was convicted of hurling body fluids on Sapulpa Officer Charles Gadd while Gadd was taking Marquez to jail following a domestic disturbance in which a woman's arm was broken.

The 1996 state law that makes it a felony to place bodily fluids on law enforcement officers was enacted amid concerns that deadly diseases, such as AIDS, could be transmitted this way.

Gadd told the jury that Marquez spit on him despite being warned and then bit him when Gadd was trying to prevent Marquez from spitting again.

Gadd and Marquez tested negative for any communicable diseases.

The jury took 15 minutes on May 14 to recommend the life sentence. Marquez's prior felony convictions, including rape and burglary, were taken into consideration in determining the sentence.

In addition to the life term, Marquez received one year in jail and a $3,000 fine for his conviction for domestic assault and a $500 fine for resisting a peace officer.

Telephone calls to the judge, the prosecuting attorney and the defense attorney were not returned today.



Isn't this country odd? Give the asshole life for spitting on someone, but not for rape. WTF?!

I don't have a problem with him getting life for spitting, but it just blows my mind that most rapists don't get life sentences for raping someone. Am I the only one that finds this to be just a little fucked up?

That's beyond fucked up. I don't have a problem with him getting life for spitting on a cop, but the fact that he wouldn't have gotten life for rape just astounds me. Either way, he's going away for a long time at least.

I'm just at puzzled as you are. Rape is such a horrible crime, that a victim/survivor never completely gets past. It's refreshing to hear a man speak so strongly against it.

the lawmakers need to be more specific than "bodily fluids".

they should say semen or whatever else it needed to be.


spitting on anyone clearly doesnt require life in prison.

this would be cruel and unusual punishment, i'm sure it'll be overturned.

Nope. If a person is enough of an idiot/asshole to spit on a cop, tossing them in jail for life doesn't bother me. Is it excessive? Yes, but considering that he's a rapist asshole, life in prison seems too light a punishment for him.

That's crazy. He should have gotten life for the rape, not the spitting, but at least he's in jail. Why is it a life sentence for spitting on a cop and nothing for spitting on someone else, except maybe a lawsuit. Why is the cop getting spit on any more important than the rape? It's not. That woman may never get over something like that, yet the cop isn't affected at all. Assault, or resisting arrest should have been the charge. People like this drive me insane. I hope he gets his ass killed in jail before he gets to appeal.

okay. spitting on people is rude and if you do it you need to be bitchslapped. but put in jail? that's fucking lame.

now if he did it with knowledge of giving a disease he should be charged with attempted murder.

I think that if you're convicted of rape, you should be raped yourself ..... and by that what I mean is violated with a hot metal rod, in a fashion that makes sure you can't reproduce afterwords.

I've been trying to figure out the sentencing thing for ages. Pick any serious crime... and you can always find some stupid idiotic case that got more jail time.

You can kill and be out with time to kill again..................... and again. But "OH MAN!" don't you dare flick off an officer, thats 90 years.... this is just some fucked up shit. He SPIT on him.. oh the FUCK well. give him a 15 dollar fine and tell him "don't spit on me anymore"

I mean... He can kill or rape anyone.. it doesn't matter WHO the person is.. but spitting? If someone spit 20 loogies on me in one day, The cops would just laugh, the courts would make me give HIM the money just for being an idiot.... yet cops.. oh they can make you go to jail for life. So.... Stuipd...... Argh!

as long as the rapist gets a prison term, I'm happy. They don't tend to last too long in jail anyways, seeing as how they're targeted by other inmates.

Same here. A guy at work tested me because he was spit on and did nothing about it. I told him I'd beat the shit outa someone if they did that to me. Well, about a year and a half ago he spit on me cause we got in an argument. I beat his ass at work. He was my union president and he fucked someone over and I told him what a pile of shit he is. It took 6 guys to pull me off of the asshole after he did it. He never told on me because I was right about the argument and he didn't think I had the balls to do it. Shit, if my grandmother spit in my face I knock her out. That is the ultimate disrespect.

spitting isn't so bad, althogh i have never spat at anyone before or been spat on. Urinating would be a much worse offence (has anyone played postal 2?)

anyway, to me, rape is almost as bad as murder. Especially on young girls, if it involves loosing their virginity.

Now c'mon man, that shit's ridiculous. I think the law hands out harsher sentences when one of them is PERSONALLY involved in a crime. If a policewoman got raped then the guy prolly woulda got life.

Evidently the convicted part of rapist didn't hurt him much - he's now put away for life which must be more than he had gotten for the rape conviction - only problem is that in Oklahoma you are elgible for parole the minute you walk in the door unless the sentence specifically states otherwise. I promise - I know too well after a long time in law enforcement in the great state of confusion.

Has anyone ever gotten life for rape? Not that someone doesnt deserve to receive such a sentence, but maybe this is a way of setting an example somehow while still giving what is deserved for the true crime. I cant make any sense of it.

i believe that there should be a life sentance imposed for rape, as i feel that it is is almost as bad/evil as murder.

i could never imagine the pain and suffering inflicted, nor would i want to anyway.

The big problem I have with this is the message it sends. The poor woman who has to think, "If he hadn't spit on a cop, he would be back on the street after what he did to me." Nice positive message there, isn't it?

In Oklahoma rape is a capital offense. I don't know anything about his case but he could have taken a long nap.

Or consensually fucked a 16 yr old when he was 19. "Rapist" means a lot of things in a paper's headline--not _necessarily_ an act deserving of death or life in prison.

Yeah, seriously, you guys dont know this dudes background, it coulda been some crazy ex girlfriend screaming rape, or some drunken 1 night stand where the chick got knocked up, and yelled rape, etc. Seriously, though w/ the prior conviction, it seems like hes probably a bad dude, i'd still say that life for spitting on a cop is wrong.
Dont get me wrong, rape is an awful and terrible crime, but we cant pass judgement on this fellow if we dont know everything about it. Don't forget that its possible that he was innocent to either of the past two charges.

All in all, i find it sick that OJ walks, and yet this dude gets life for spitting on a cop...
