Credit card fraud? wtf??
ok a little backstory, for about a month now whenever i purchase something with my credit card at a store (card is under my name) and i get a reciept to sign i would always write some random crap or draw a star or something instead of putting my real signature, i dont know why i did that it was sort of funny..Noone ever noticed this or say anyhting back at me other than some laughs from the younger cashiers and a 'what the hell' look from the older ones.
Up until now everything was fine until today. I recieved a letter from my credit card company saying I've been charged with fraud worth $3000 (my credit limit isnt even that high). I checked my account summary online and no weird charges or anything have been made, everything seems fine. I called the card company and they said my account was locked due to fraud and they couldnt help me with it at the time..The court date is 2 months from now and my account has been locked..wtf??????

well the first thing you need to do is read over your TOS agreement.. then call them back. It's your account and they have to instruct as to why the account is closed because of fraud.
I'm guessing that they are thinking that numerous people used it or something. |

Sounds like you need a lawyer. It could be a lot of things, and you won't know until you get more information.

Odds are, they're actually trying to protect you. They suspect multiple people have been using the account, and want you to physically come in to verify your identity. All of your credentials could be forged over the phone/mail, but they can't physically appear as you in court.

about a month ago i tried to use my credit card but it wasnt working. i then went online to check my balance and noticed some transactions on my statement that were made in germany. i havent been to germany (not yet anyways). apparently they had locked my account for my safety, and there had been a few transactions, some of which had not yet appeared on the statement yet. they also told me that someone had tried to use my ATM card overseasat an ATM but got the pin number wrong even though my card was with me. so maybe it wasnt your crazy signatures...maybe you were in fact a victim of fraud. talk to them. did they hit you with a court order? otherwise how can you go to court without being served a court order?

I've gotten regular calls for being "fraud protection" and then one day they just turned off my card. Was a pain in the ass, no fraud, just happened to screw up some Xmas purchases.
A week later I did get another notification and it turned out someone used my card number in Denmark and other european countries. I have to still deal with that. Credit cards are not a joking matter. Each transaction you are signing is a contract. You may not think that it is and may find it trivial, but it isn't. It is a contract binding just like any other contract.

Hm, I don't really understand: are they charging you $3000?
If so, there are probably lawyers that are specialized in the field of fraud/credit card legalese. I don't know what else to say but good luck.

This is just a guess, but by signing the receipt you would be entering into a contract to repay the credit card company as per the terms of your account. By not signing it, there is no guarantee that it is you that is making the transaction. You could claim that those transactions were not made by you and the only proof they could offer is by providing an image of your signature, which of course you did not provide.
The retailer should not have completed the sale until you signed the receipt. But they did and now the credit card company is pizzled. Follow gucclivr's advice. Read the agreement. Then get a lawyer. |
