Calif. Man Wins Airplane Toilet Ice Suit

SANTA CRUZ, Calif. - A Santa Cruz man won a suit against American Airlines alleging that one of the company's planes released two chunks of toilet waste, known euphemistically as "blue ice," onto the skylight his boat

After the chunks came crashing down and damaged his boat, Ray Erickson tracked down the plane — American Airlines Flight 1950 — and sued in small claims court.

He receive'd the court's ruling in the mail Friday. A judge ordered the airline to pay him $3,236 - almost the entire amount Erickson had sought.

Mike Fergus, a spokesman for the Federal Aviation Administration, was surprised at the decision.

"I'll be darned," said Fergus, who hadn't heard of any similar suits succeeding before.

The airline has 30 days to appeal the ruling. Airline officials could not be reached to comment Saturday.

i'm glad he won.
at least he didnt sue them for millions of dollars

Tom Thumb 06-15-2003 04:50 PM

Yeah, I agree. Freak occurence, but the airline was responsible.

It's not as though $3200'll bankrupt anyone in any case, so it sounds like he actually just wanted to repair his boat.

Halx 06-15-2003 05:00 PM

Amen for this. There is no shame in suing for ACTUAL damages at the amount that the damages are worth.

BoCo 06-15-2003 05:04 PM

Watch the airline spend 10 times the amount to try to fight it, when it'd be cheaper and more honorable to just pay the guy.

Or the airline will simply drag it out long enough that it's not worth this guy's time and effort to recoup the three grand. That way there remains no legal precident for awarding damages for these cases.

Agreed. It's annoying to see those kinds of lawsuits. Hope the airlines don't fight him so he gets the cash.

rockzilla 06-15-2003 06:03 PM

He did get the cash, the title of the article even says he won the suit. I'll echo a few other people here though and say I'm glad he didn't try to sue for millions though. I'd be interested in knowing where the frozen shit landed, was his boat docked, or out on the ocean? Airlines shouldn't be dropping big cubes of frozen waste anywhere near land.

Edit : I suppose the airline could appeal, but what judge in their right mind would overturn this?

BBtB 06-15-2003 07:33 PM

He got the money for repairs to damage they caused. Seems logical to me. I don't see why they are just dumping their crap (hehe... literally) anyway. I mean is it SO hard for them to just hold that and unload it on land? I mean you can't tell me at this age that we can not put a tank on a plane to hold the crap for one flight.

YourNeverThere 06-15-2003 07:47 PM

BBtB has it right, why dump it over the ocean? its just dangerous

MacGnG 06-15-2003 08:10 PM

yea 3200 is no biggie for them, maybe like 5k he coulda gotten but no need to be greedy

KeyserSoze 06-15-2003 08:56 PM

I wonder if they will write Block of Frozen Shit in the memo section on the check they give him:hmm:

merkerguitars 06-15-2003 09:47 PM

Perfect outcome I think. Yeah good point, Why can't just they just drop that stuff in the ocean or in the middle of the desert.

If it lands in the desert, it'll take quite a while to break down due to the dry environment. You could be hiking through Death Valley and come across ten-year-old piles of dried shit. Plus, it could hit someone there.

Just go with the ocean, as long as that blue stuff sterilizes it and doesn't risk spreading nasty diseases to wherever it washes up.

I think this is almost as bad as suing McD's because their coffee is hot... some things don't deserve to be sued over. (*I would have laughed at the situation. Good story to tell the kids.*)

oblar 06-16-2003 06:42 PM

have to say that I am happy with this. I am tired of people suing large corporations for massive amounts of money for no better reason than to get at a piece of their deep pockets. A reasonable amount, to repair the damage that was not the man's fault. Very reasonable.
