The songs aren't in mp3 format. They're in AAC (mp4) format. I'm not 100% positive but I'm pretty sure you need iTunes to play them.
The obvious workaround is to burn the tune to CD and then re-rip it back into mp3.
I'm also almost positive that iTunes does NOT use any Spyware of any kind.
