how do you know they don't want the estate or anything? My point to that is.. if you really feel guilty, find a way to ask them.
Also, if you do take it, I would suggest making something in his name.. especially if he was a good neighbor which i assume, cause if you hated him, you wouldn't be asking this question as the fence would already be up. heh I believe in an afterlife, and I think it would make him happy to know you were able to use what he cannot, and more importantly that you took it thinking of him.. and that as long as the fence has str.... you'll always remember him.
