Dude, they've been doing that for more than 10 years! Remember all those Commander Keen games, Duke Nukems? Apogee games? They have every right to do so, you're playing a portion of a retail game for free, so of course they're going to want some money payback from you somehow.
I haven't played the demo as yet but the full game does have a few performance issues (yes, even on my FX 5900) but it doesn't really bother me 'cause I found the game uninteresting.
