In a modern context, arresting someone, trying them, convicting them, appeal after appeal, and then finally killing them- The crime and the victims are so far removed from the penalty, it offers no deterrence.

So why not revamp the current appeals process instead? You did it, and we're -sure- you did it, the guard caps you right there in the courtroom. Maybe have the defendent standing on a tarp to eliminate some of the mess. That would sure as hell deter -me- if I saw that.
