Sadly, such a lawsuit is far from being unrealistic.. Especially in America.
People sue for the dumbest things... and win.

Very true. How about that woman who sued McDonald's for hot coffee? She opened it between her legs while her son was driving. She received 3rd degree burns from the coffee. She won.
I saw another lawsuit against a bicycle manufacturer. Some guy was biking at night without a light. He was hit by a car and paralyzed. His lawyer said that putting reflectors on the bike misrepresented the safety of riding at night. The guy claimed that the bike company should have warned him not to ride at night. Last time I checked, the case was still pending.
These people win because juries are stupid. (I know that's a very blanket statement. There are some good juries). Many juries award massive punitive damages. I think that there should be a limit on punitive damages. Sometimes I think that at least part of punitive damages should go back to the state for programs to prevent the same thing from happening. Compensatory damages should remain the same and go to the plaintiff. I also think that people who lose frivolous lawsuits should be forced to pay court costs (otherwise we are the ones who end up paying).
