There was a case a few years ago when an anesthesiologist in her forties sued and won against her OB when she had a kid with Down's. A lot of kids with that are able to develop pretty well and most understand there condition.
Here are my concerns:
How does an MD sue and win because she claims she did not know she was at increased risk for Down's and was not offered an amnio? If she really is that ignorant, she should have her licence taken away.
How does a practicing MD in the community not know the practice style of the OB she picks to deliver her baby?
How does a mother explain to her child as he grows older that she won a lawsuit because she would have chosen to abort him had she know that he was not perfect?
I don't know about how much experience you all may have had with kids with Down's. Mine has been limited, but in a variety of settings. I have never met a person with Downs who was not happy, at least happier than average. Sure, they and their families suffer in many ways; but their lives have great value and they enrich those who meet them.
