Imho, the women that fall "victim" to the stipulation are the ones that do not take their responsibility, or figure that the rules don't apply to them somehow.
China has a serious problem with overpopulation, so the government has told them again and again that this is in fact a very easy way to reduce the population, to use their common sense and realise it can't go on like this. They told them the why and how.
And accidents with contraceptives happen all the time, I agree. So do the right thing in that case and end it within the first 2-3 months.
