Where does the "third brother" stand on this? You've mentioned that he exists, but that's all you've said about him.
I mentioned your situation to an attorney acquaintance last night and he was just full of questions.
How is the "property" held by the three of you? Is it currently held in joint tenancy or as tenants in common? Is it held by a corporation, LLC, S-Corp? Are the three of you in a legal partnership?
What kind of "property" is this?? Is it a city house and real estate? A condo? Farm or ranch land? An acreage? Is it platted?
How many times have you said this before? Maybe you should talk with an attorney before you talk to Big Brother again.

The other brother lives out of state. I have not talked to him about this since the other brother brought all this up.
The property is the family home which the three of us inherited by will when my mother died 8 years ago. Although we do have some property in an LLC, this house is not owned by the partnership, it is owned by the three of us. Not sure of the legal terminology for that. It is a home on 2 acres located in a suburban neighborhood. I do have an attorney I can talk to, which may be my next step.
