Let's see how Perry v. Schwarzenegger plays out. The Court already laid the groundwork in
Griswold, Loving, and Zablocki. I for one, would be surprised if it did not come out in favor of the same-sex couples.
Taking the 14th's Due Process concept of 'privacy' and it's 'respect for the marital bedroom' it does seem like such a policy would be in contravention of the 14th Amendment.
