I think lurkette's post weighs heavily on the theory that there is a lot more to this case that what she is attention-whoring around town. Sounds to me (in my professional law opinion) that this isn't a clear cut case of "She is to hot to work here". I mean, it was Manhattan for christ's sake! I would think that that the level of hotness would be just as high as the Hollywood/LA area. Where you have wannabe models, hot girl pop stars, actresses, and the like working waitressing jobs to pay the bills til "They become famous and don't have to work"!
You are right, she shouldn't be fired for dressing hot/looking hot, but I don't think this case is about that.
This just sound fishier everyday and like Cinn said, this happened LAST YEAR. Why is she dregging it up now? Not getting the out-of-court settlement she wants? Something is rotten in Denmark, I'm thinking its the smell of desperation.
