If the truss rod is broken or the nut is worn after a month of use, I'd be demanding my money back.
Seriously, get it looked at by a pro. I generally consider a proper setup as part and parcel of the whole new instrument thing anyway. It's a good idea to have everything adjusted regularly.
Guitars are fairly common, and as a result seem to get neglected. If you take care of your instruments, they'll take care of you. Guitars need maintenance regularly, just like anything else.
