Being an ass is using a term like "malice aforethought" and not understanding it. All it means is intent to cause grievous injury where death is the intended result.
But hey, as long as
you don't want to think of it as murder. And BTW, US soldiers are under the jurisdiction of the USMJ and Iraqi law. You should familiarize yourself with the difference between those and what's going on now.
