Well I'm not 100% positive but all the hints and insinuations seem to point that way.
Consider:
So far, it is appears Sylar possess the power of telekinesis (based on previous episodes). In the diner, we see him "pull" the mug to his hand with telekinesis (or the force). As an establishing shot, I presume this is the way that the TV producers let the audience know that the character is Sylar. Other similarities abound such as the hat, pervasive shadow across the face. The trend of these shots imply Sylar (but yeah, it is definitely possible that it's not and that this is a red herring designed to fool the viewer).
