A lesson to everyone out there: IF you are ever in an accident, and if you were clearly at fault, DON'T APOLOGIZE TO THE OTHER DRIVER....because if THEY apologize, you now have legal precedent.

The other driver apologizing really has very little influence on whether they can, and will, sue. Once they talk to an attorney or their friends/family, their story can change. Identify as many witnesses as you can than verify and support your version of the circumstances.....just in case.
An apology is not a "legal precedent". A precedent is legal principle, created by a court decision, which provides an example or authority for judges deciding similar issues later. It has no relationship to the driver's apology.
