However I can't imagine that if the police want to search your car/house etc.. that they won't just claim that they saw, heard, smelled something that require a search without waiting for a warrant. In other words if they want you you're toast.

But they take a risk to do that. If they pull me over and search my car without permission or a warrant, and claim that they smelled marijuana, and then they don't FIND any marijuana, they're up a creek. How could they have smelled it if there isn't any there. Now we have an illegal search.
